Tennessee's had a rough stretch of rain, and we're fielding a lot of calls about flooding and moisture in new construction homes.

Homeowners: Before you do anything else, pull out your builder's warranty and inspection paperwork from closing — it spells out what's covered, what's not, and how to file a claim under your warranty. Time matters, too. Claims have a statute of limitations, and we've seen homeowners lose their ability to act simply because they waited too long after noticing an issue. Check your documents, note when you first saw the problem, and reach out sooner rather than later.

For contractors and builders: you're not powerless here either. Proactively documenting storm-related callbacks, responding quickly to warranty claims, and keeping clear records of grading, drainage, and waterproofing work at the time of construction all protect you if a dispute arises later. If a homeowner reports an issue, addressing it promptly and in writing is often the best defense against a claim escalating — and it's good business besides. It's also worth reviewing your contract documents with an attorney annually (subcontractor agreement, construction agreement with homeowners, builder's warranty, etc). Markets change and your contracts may need to change as well.

Whichever side of this you're on, the same rule applies: don't wait. Documentation and timing make all the difference.

Attorney Spotlight: Abbie Dierbeck

Abbie Dierbeck is an associate attorney at Anderson Legal, PLLC in Nashville, Tennessee, where she practices in the areas of construction, real estate, business, and entertainment law. She represents contractors, developers, business owners, and creative professionals, providing strategic counsel on contract negotiations, transactional matters, and dispute resolution. Drawing on a diverse professional background, Abbie delivers practical, business-oriented legal solutions tailored to the industries her clients operate in.

Prior to joining Anderson Legal, Abbie developed a strong foundation in both the entertainment and business sectors. She earned a Bachelor of Business Administration in Music Business, cm laude, from Belmont University’s Mike Curb College of Entertainment & Music Business. During her undergraduate studies, she completed internships with the Country Music Hall of Fame and Museum, the Country Music Association, and Mystic Lake Casino, where she gained experience with artist agreements, sponsorships, and live event operations.

Abbie continued to build on this foundation while attending Belmont University College of Law. She was the recipient of the CALI Award in Negotiations and was actively involved in the Entertainment Law Society. During law school, she interned with CMG Worldwide, A3 Athletics, and the Nashville Predators, where she worked on a variety of transactional matters, including music licensing, publishing agreements, brand partnerships, ticketing, and sponsorship agreements. These experiences further strengthened her ability to approach legal issues with both a commercial and strategic perspective.

Following law school, Abbie served as a contract attorney with Motley Rice, where she conducted complex litigation document review and assisted in drafting case strategy memoranda. This experience enhanced her analytical rigor and attention to detail, which she brings to her practice today.

Abbie’s combined experience in entertainment, business, and transactional work provides her with a well-rounded perspective that she applies to her construction and real estate practice, particularly in matters involving contract structure, risk management, and long-term business planning.

She remains actively engaged in both the legal and broader Nashville communities. Abbie is a member of the National Association of Women in Construction (NAWIC), where she supports and connects with professionals across the construction industry. She is also involved with the Country Music Hall of Fame and Museum’s Troubadour Society, maintaining a continued connection to the entertainment industry that shaped her early career.

A former hockey player, Abbie thrives in fast-paced, competitive environments. Outside of her practice, she enjoys strength training, live music, and traveling—having visited 16 countries and counting.
