Distracted driving is a huge problem with devastating consequences. Almost all of my serious injury cases involve distracted driving. According to a recent study, Tennessee had the highest rate of distracted driving deaths in 2018 - last year, there were over 24,600 crashes involving distracted drivers, roughly 67 crashes a day.

On July 1, Tennessee’s new distracted driving law takes effect. The new law makes it illegal for people to drive while holding or supporting a cellphone or mobile device with their bodies. Hands-free devices are allowed. A violation will be a class C misdemeanor, punishable by a $50 fine for a first offense; $100 for a third or higher offense or for causing a wreck; and $200 in active work or school zones.

One person died as a result of a chain-reaction crash involving 11 vehicles, including a semitrailer, on Interstate 24 east in Lyon County, Kentucky, Friday, state police say.

This morning I attended the initial hearing in the 3M Military Earplug litigation in Pensacola, Florida, the multidistrict litigation (MDL) against Minnesota-based 3M recently assigned to Judge M. Casey Rodgers of the U.S. District Court for the Northern District of Florida.

To date, over 640 injury lawsuits have been filed by military veterans alleging that 3M military earplugs were improperly designed and knowingly supplied to the Department of Defense with incomplete instructions for use. The plaintiffs allege they suffered significant hearing loss or tinnitus as a result of the improper design and insufficient instructions.

3M recently paid $9.1 million to settle a case brought by the U.S. Department of Justice over the earplugs.

Last week I filed a federal lawsuit against Monsanto Company on behalf of an individual who developed non-Hodgkin’s lymphoma believed to be caused by exposure to Monsanto’s Roundup. As much as we collectively would like to think this injury is a rare occurrence, this is the fourth Roundup lawsuit I have filed in the past few months and the number of lawsuits filed against Monsanto continues to grow steadily.

The first trial against Monsanto ended on August 10, 2018 with a unanimous jury verdict of $289 million (later reduced to $78.5 million) for a Benicia, California school district groundskeeper. Most of the Roundup cancer lawsuits are filed in various state courts. Others have been consolidated in a federal multidistrict litigation (MDL) in Northern California.

The main ingredient in Roundup, glyphosate, may cause serious side effects. The World Health Organizations International Agency for Research on Cancer (IARC) classified glyphosate as a “probable human carcinogen,” in addition to linking the chemical to antibiotic resistance and hormone disruption. Courts have begun to hold Monsanto accountable for harming consumers, and the number of lawsuits against the agribusiness corporation have increased.

Today I filed a lawsuit against Monsanto Company on behalf of a man who developed Non-Hodgkin Lymphoma due to exposure to Monsanto’s Roundup.

Roundup is the world’s most widely-used herbicide, present in 160 countries with more than 1.4 billion pounds utilized per year. Though Roundup is intended for household yards and sprayed on acres of crops sold at local grocery stores, the w**d killer may cause serious effects to human health. The World Health Organizations International Agency for Research on Cancer (IARC) classified Roundup’s main ingredient, glyphosate, as a “probable human carcinogen,” in addition to linking the chemical to antibiotic resistance and hormone disruption. Despite the risks, an estimated 2.6 billion pounds of Roundup has been sprayed on U.S. farms alone.

Research has shown glyphosate may cause the development of tumors in mice, stay present in farmworkers urine, disrupt gut bacteria and increase the risk of cancer. Some individuals exposed to Roundup have reportedly been diagnosed with various types of lymphoma, including:
- Skin lymphoma
- Burkitt lymphoma
- Peripheral T-cell lymphoma
- Mantle Cell lymphoma
- Follicular lymphoma
- Hairy cell lymphoma
- Large B-cell lymphoma
- Non-Hodgkin’s lymphoma

Monsanto’s use of glyphosate in industrial agriculture and consumer products may cause serious side effects. Courts have begun to hold Monsanto accountable for harming consumers, and the number of lawsuits against the agribusiness corporation have increased.
