Chuck Allen Floyd is an Oklahoma native whose life and career has woven back and forth between Corporate Law (both as a corporate defense attorney and start-up business owner) and the Music Business (as a staff-writer on Nashville's Music Row, popular Texas Red Dirt performer, and Producer). While attending The University of Oklahoma College of Law, Chuck was President of the Board of Advocates, twice President of The Federalist Society, Student Delegate to The Law School Ethics Committee, was awarded the American Jurisprudence Award for Civil Procedure II, and a member of the National Moot Court Appellate Advocacy Team. He was also chosen to serve as the law school’s delegate to conferences on Antitrust at the University of Chicago and the evolving role of government at Harvard University. In music, Chuck has worked as a staff songwriter at country music icon Clint Black’s Blacktop Music Group and holds the distinction of being the only person to win the Billboard Magazine World Songwriting Contest two years in a row. His song, “The Talent Requires” (performed by James Lann) was not only #1 on both the Texas Music Chart and Texas Regional Radio Report; it was among the ten most played songs on Texas radio in 2010. As a performer, Chuck has played virtually every venue, reputable and otherwise, in the “Texas Red Dirt” circuit and, beyond that, from New England to “Old” England, sharing the stage with a list of writers and performers that includes Guy Clark, Dweezil Zappa, Dean Dillon, Leeanne Womack, Blake Shelton, Montgomery Gentry, Randy Rogers, Mel McDaniel and many, many more. A popular guest speaker also, Chuck has been a panelist on many music industry panels and has served as a guest speaker for Nashville Songwriter Association International (NSAI) chapters across the country. Floyd’s broad experience in both the legal and “hands on” business world brings his clients a highly unique perspective. It is one thing to study publishing contracts as a concept in musty books; quite another to negotiate, sign, and live with the consequences of the contract as a creator of intellectual property. Similarly, it is one thing to know the steps to creating a corporate entity and structure and another to have created businesses and run them successfully. After much travel, Chuck now lives happily in Conroe, TX with his wife Chelsa and son, Augustus.

Congratulations to Josh on another chart-toppin' hit!

Texas Regional Radio Report for week ending 4/23/26 has been published. Top spot goes to Josh Weathers Music with "Life Still Happens". Find entire chart results at https://www.texasregionalradio.com/Top100.asp

Josh Weathers is a Texas-born country-soul singer known for his powerhouse vocals and emotional live performances, and in 2026 he earned the prestigious title of TRRMA Male Vocalist of the Year.

Josh Weathers built his reputation on a rare blend of country, soul, gospel, and rock influences, delivering performances that feel as heartfelt as they are explosive. His voice—often described as a once‑in‑a‑generation instrument—first captured statewide attention as he and his band became known for genre‑blurring shows that moved effortlessly from tender ballads to high‑energy jams.

Beyond his musical talent, Weathers is recognized for his deep sense of purpose. At the height of his early momentum, he stepped away from touring to focus on humanitarian work with his wife, launching efforts to support children in India and El Salvador, for which he and Kady received the TRRMA Humanitarian Award for 2026. That chapter added even more depth to his artistry, and when he returned to the stage, fans and critics alike noted the renewed fire and conviction in his performances.

His career reached a new milestone in 2026, when the Texas Regional Radio & Music Awards honored him as Male Vocalist of the Year, a recognition voted on by fans and industry members across the Texas/Red Dirt music scene. This award placed him alongside the genre’s most respected artists and affirmed his standing as one of Texas music’s most compelling voices.

Today, with a publishing deal at Sea Gayle Music and a growing catalog of soulful, truth‑driven songs, Josh Weathers continues to carve out a unique place in modern Texas music—one defined by authenticity, heart, and a voice that leaves a lasting mark.

SHOULD I TRADEMARK MY BAND'S NAME?

Short answer: Yes. Your band name is more than just a label—it’s the cornerstone of your brand identity and your musical legacy. Don’t leave your hardest work unprotected.

Why trademark your band name?

1. Nationwide Protection: Secure exclusive rights to your name across the country, not just in your local scene.
2. Merch & Revenue: Protect your music from takedown claims, and your t-shirts, vinyl, and gear from unauthorized copycats.
3. Ownership Clarity: Prevent future "Who owns the name?" disputes if a member leaves the group.
4. Avoid Problems: There are enough problems in the music business; TM problems are avoidable - so avoid them.

Stop worrying about imitators and start building your empire. 🎸⚖️

POV: You just found out you have unclaimed royalties. 🤯

Most independent artists are missing out on mechanical and performance royalties simply because their songs aren't properly registered. It’s not just about releasing music—it’s also about protecting your rights as a creator.

Steps to take right now:

1. Check your songwriting/publishing PRO registrations.
2. Check your Mechanical Licensing Collective (MLC) registrations.
3. Check SoundExchange for digital performance royalties.
4. Make sure your information is up to date with your distributor.
5. Ensure your ISRC codes are consistent across all platforms.

Still confused? That’s what we’re here for.

Are Band Members Independent Contractors or Employees?

While the vast majority of working musicians are treated as independent contractors, the IRS might have a different view. Factors such as:

1. The amount of control the artist has over the band member,
2. Financial aspects of the work, and
3. The nature of the relationship

could cause the IRS to determine that a band member is actually an employee--placing various responsibilities on the the artist, including the duty to withhold and deposit various employment taxes.

Have a Band Member agreement clearly setting forth the nature of the relationship AND what happens in the event the IRS determines an independent contractor is actually an employee.

Are you in an "Unintentional Partnership?" 🤔

If you and your collaborators (band members, investors, etc.) are acting like co-owners—sharing costs, gear, and streaming royalties—you’ve likely formed a General Partnership under the law.

Why this matters in 2026:

Potential Unlimited Liability: Under the right (or wrong) circumstances, you can be held 100% responsible for your partner's business actions.

Default Rules: Without a written agreement, state law may decide how you split money and rights, not you.

Asset Risk: Your personal savings could be at stake if the partnership is sued.

Nobody ever picked up a guitar hoping it would lead to contracts and math...but it does. Be careful out there.

In 2026, the real "flex" isn't just using AI—it's having the legal rights to keep what you make. 🛡️✨

The "Human-Only" Copyright Rule means that while machines can generate, they cannot own. As a human creator, this gives you a massive advantage in the digital economy. ⚖️💼

Why Humans Still Win:
1. Asset Ownership: Content generated solely by AI typically falls into the public domain, meaning anyone can use it for free. Only works with "substantial human creativity" can be registered for full protection.

2. Commercial Security: Brands in 2026 prioritize human-authored content because it's enforceable. If your work isn’t copyrightable, a competitor can copy it without legal consequences.

3. Human-in-the-Loop: You can still use AI as a tool! If you provide the "creative selection, coordination, or arrangement," you can often protect the final product.

The future belongs to creators who use AI to work faster, but keep their "human touch" to stay protected. ✍️🚀
