Another successful case for our Jo Kaucher, whereby her submissions were successful and the ICP concluded that there was no case to answer.

Jo submitted written representations to the Investigating Committee Panel of the HCPC on behalf of a paramedic facing fitness to practise concerns following an allegation that he had assaulted a colleague at work.

The representations focused on his firm denial of the allegation, as well as the wider context, including his position that the gestures in question were made in jest and had been misinterpreted as “banter.” Jo also focused on why there was no misconduct and no impairment to his fitness to practise.

Our regulatory law team leader, Jo Kaucher, recently submitted written representations to the Investigating Committee Panel (ICP) of the HCPC on behalf of a paramedic facing fitness to practise concerns.

The concerns arose from comments made during a live video posted to their employer’s Facebook account, which were considered inappropriate and offensive.

The representations focused on demonstrating that there were no misconduct and no impairment to the registrant’s fitness to practise, looking carefully at the context and the relevant regulatory framework.

We are pleased that the ICP accepted those submissions and concluded that there was no case to answer.

Jessie Slim recently represented a client at a sentence hearing at Croydon Magistrates Court. The client had self-represented prior to sentence and been convicted at trial of assault by beating.

Prior to this incident she had been entirely of good character and the conviction meant that she was at risk of losing her career of 26 years as a midwife in the NHS.

The starting point for the offence was a high level community order with a range of low level community order to 26 weeks custody.

Jessie made submissions to the court that given the unique circumstance of the case and her client’s significant personal mitigation including the possible loss of her career, the court could step outside the sentencing guidelines and grant a conditional discharge.

Jessie mitigated on her good character and professional dedication to public service. She also noted the abusive behaviour of the complainant in the lead up to the offence and further persuaded the court that in the circumstances compensation was not appropriate.

In sentencing, the court recognised that this was a “very unique case” and despite the offence falling within the highest category under the sentencing guidelines, the mitigation advanced meant the court could step outside the guidelines on this occasion and impose a conditional discharge.

This case was a clear reminder of just how important access to legal representation is, and the difference it makes to have someone in your corner. The client didn’t qualify for legal aid, but also couldn’t afford private representation at trial, so she had to represent herself until sentencing. Unfortunately, this is a situation many people face in the Magistrates’ Court.

It doesn’t feel like proper justice. It’s hard not to think the outcome might have been different if she’d had representation at trial. Access to proper legal representation shouldn’t depend on what someone can afford.

Unanimous acquittals for gross negligence manslaughter and wilful neglect secured.

We are pleased to share that our Partner and Head of our Regulatory team, Gary Rubin, had secured a unanimous acquittal of all charges. This result was following an 8 day trial at Wolverhampton Crown Court which began on the 13th July 2026.

Our client, Mr Bennett, had been prosecuted for two offences – gross negligence manslaughter and wilful neglect that arose from a tragic death of a resident in February 2023. After careful consideration of the evidence, the Jury returned not guilty verdicts on both counts.

Samantha Christien successfully secured an acquittal for a police officer accused of harassment.

The case involved detailed preparation, including securing important background evidence, obtaining expert evidence from an Islamic scholar, pursuing disclosure and taking statements from 14 defence witnesses.

Following cross-examination at trial, the court rejected the prosecution’s case, finding that no harassment, alarm or distress had been caused or intended. The officer was acquitted and awarded a defence costs order.
