This client came to GigaLegal after their Skilled Worker visa application was refused based on false representation, following a failure to disclose a previous refusal.
The consequence was serious, as the refusal also imposed a 10-year ban.
We took over the matter at that stage.
After reviewing the decision and the application history, we challenged the Home Office through the Pre-Action Protocol process.
The Home Office did not accept the challenge, so we proceeded with Judicial Review.
That first Judicial Review resulted in the Home Office agreeing, by way of a consent order, to reconsider the decision.
But reconsideration did not bring the case to an end. The Home Office refused the application again.
At that point, we could accept the second refusal, or challenge the matter again where we believed there remained proper legal grounds to do so.
We issued a second Judicial Review.
Once again, the Home Office agreed to reconsider the matter through a consent order.
This time, the reconsideration went much further.
The Home Office arranged an interview with the applicant and, separately, an interview with the sponsoring employer.
That required careful handling on both sides.
After almost two years, two Judicial Review challenges, two Home Office reconsiderations, and separate interviews with both the applicant and the employer, the case finally concluded with a successful outcome.
