Want to know another advantage of resolving common disputes using NDR (Neutral Driven Resolution)? NDR negations are all done quietly and amicably, avoiding the potential headlines that litigation often bring. Here’s an actual example:

An investor group suspected that their once-promising biomedical start-up was not being managed well but did not want to blow up ongoing negotiations to sell the company. Instead of litigation, the group retained an NDR facilitator to make inquiries. The start-up cooperated, the parties resolved their differences, and the sale went through as planned. A win-win!

The best way to ensure the use of NDR – Neutral-Driven Resolution – to resolve common conflicts is to insert a clause in the contract at the time of signing that stipulates that NDR will be employed should the parties have a dispute. Example:

A tech start up refused to pay any of a $12,000 progress payment to a small website design company after cancelling the contract. Outside counsel for the tech company was a national law firm that dared the design company to sue. Instead, the design company invoked the NDR clause in their contract, which opposing counsel had apparently failed to read. Within a week, the design company was paid the full $12,000!

Here’s another actual example of how NDR – Neutral-Driven Resolution – was used to settle a common dispute without lengthy and costly litigation.

A small stakeholder in a candy business received nothing when the business later sold. The stakeholder suspected foul play. A neutral dispute outreach by an NDR provider on behalf of the stakeholder enabled a cooperative investigation and litigation-avoiding answer to what occurred at a cost of less than $1,500. SWEET!

Settling common business disputes using Neutral-Driven Resolution (NDR) works. It’s faster, less expensive and provides real justice. But sometimes just the threat of resorting to NDR is enough to get the parties to the table. Such as:

A former employee claimed he had been set up to fail and wrongfully terminated. When negotiations bogged down, the employer’s lawyer offered NDR to settle the case. The employee accepted, but before the NDR process started, the parties negotiated an acceptable settlement.

When it comes to resolving contract disputes, you need a solution that works. Followers of my posts know that I’ve been a strong advocate of Neutral-Driven Resolution (NDR). Why? Because it offers a faster, fairer, and more collaborative way to reach a resolution than traditional alternative dispute resolution methods.
