New York City Drops the Hammer: Final Collection Rules Take Effect 9/1/26

NYC has issued its final debt collection rules, currently set to take effect September 1, 2026 (subject to possible delay). The 48-page Rules significantly expand compliance obligations in all five boroughs and often apply to creditors collecting their own debt.

Major changes include stricter contact limits, expanded disclosures, enhanced dispute and verification requirements, broader recordkeeping obligations, and a ban on credit reporting medical debt.

Collectors, debt buyers, and creditors should begin preparing now. We are here to help.

ChatGPT Is Not Your Lawyer’s Associate 02/26/2026

In a New York federal securities fraud case, a defendant used a commercial generative AI platform to draft his defense strategy and later shared it with his attorneys. When prosecutors sought the AI created document in discovery, the defendant claimed attorney client privilege and work product protection.

The court disagreed. It held that entering sensitive legal information into a commercial AI tool is effectively disclosing it to a third party, defeating any reasonable expectation of confidentiality, particularly on free platforms. The work product doctrine also did not apply because the document was not created by or at the direction of counsel. Neither the defendant nor the AI was acting as the attorney, and the lawyers had not directed the preparation of the summary.

The takeaway: Do not use AI tools in connection with an active legal matter without first consulting your attorney. Materials generated independently, even if later shared with counsel, may not be protected and could be discoverable.
