A protective order should be a shield for someone who truly needs protection—not a strategy for gaining leverage in a family law dispute.
On All Things Legal, Doug Sunseri discusses a difficult issue he has seen repeatedly throughout his years practicing family law: allegations being used to gain an advantage in custody or community property disputes.
When that happens, the consequences can be serious. A parent may find themselves facing protective order hearings, DCFS involvement, forensic evaluations, and the nearly impossible task of trying to prove something didn’t happen.

ASK KATIE ⚖️ | Is a verbal agreement legally binding in Louisiana?

The short answer: it can be.

You don’t always need a written contract for an agreement to be enforceable. In Louisiana, a verbal agreement may be binding when both parties have the legal capacity to contract, agree to the same terms, and the agreement involves a specific and lawful purpose.

But there’s an important catch: if the agreement is worth more than $500, Louisiana law generally requires at least one witness plus other circumstances that corroborate the agreement in order to prove it in court.

Certain transactions, including some involving real estate, must be in writing to be enforceable.

So, “we only shook on it” doesn’t necessarily mean there was no contract. What matters is what was agreed to, whether both parties intended to be bound, and what Louisiana law requires.
