⚖️ A SIGNIFICANT OUTCOME AT THE COURT OF APPEAL

Today, our legal team lead by our Senior Partner Adrian Oswald Oswald, successfully obtained a stay of ex*****on from the Court of Appeal by a majority decision of 2–1.

Our client is pursuing an appeal to the Federal Court. In the meantime, bankruptcy proceedings had been commenced against our client and were scheduled for hearing tomorrow, 14 August 2026.

Without a stay, there was a real risk that the bankruptcy proceedings could overtake the appeal and prejudice our client’s ability to pursue the matter before the Federal Court.

With today’s order, the ex*****on of the judgment is stayed, preserving our client’s position and ensuring that the appeal can proceed without being rendered nugatory.

This outcome is an important reminder that litigation is not only about the final judgment. Timing, strategy and the appropriate interim relief can be equally crucial in protecting a client’s rights.
