You might be wondering what this hearing is about.

Essentially, the Bologna Court challenged the constitutionality of Italy's Ius Sanguinis Citizenship law, leading to the suspension of ALL citizenship cases in Bologna Court. Bari and Perugia Courts have followed suit.

Now, we finally have a date for the Constitutional Court to settle the debate!

Dual citizenship for Americans - WEEKLY DOSE

And then came October.

October has been a disheartening month for families around the world seeking to obtain Italian citizenship recognition (a birthright). Specially Americans.

Initially, we faced the issuance of a directive (Circolare 43347) from Ministero dell'interno that severely restricted the recognition of citizenship rights based on Supreme Court decisions that are universally acknowledged as non-binding (the "minor issue").

It has been challenging to explain to American clients how a government can issue a directive that limits their inherent birthright based on non-binding rulings.

The "minor issue" was explained in a post done six months ago on LinkedIn Posts. If you haven't read it, please do.

Moreover, yesterday, we were met with the discouraging news on the 2025 Italian budget proposal to impose a fee on each individual plaintiff when filing a lawsuit related to Italian citizenship recognition. This is yet to be unfold, and we will watch it carefully.

It is astonishing that while Italian politicians and the Italian government are actively working to restrict oriundi birthrights, they simultaneously have ideas like "turismo delle radice" which is to promote tourism for us, oriundi, to spend money in our ancestors' land in Italy.

This raises the question:

Are we, oriundi, considered valuable enough to contribute to the Italian economy through tourism and spending, but not worthy enough of having our fundamental birthrights recognized?

It is undeniable that our families have maintained a strong connection to Italy throughout generations, fostering a sense of pride in our Italian heritage.

The same connection our Italian politicians saw when writing the Law n.555 back in 1912....

The 2025 budget proposal for Italy is about to be voted on.

And in it, there is a proposal to institute a tax to be paid by each person who files a lawsuit regarding Italian citizenship recognition.

Let's say a family of 5 people wants to file a lawsuit, these 5 people will pay the lawyer's fees + 600 euros per person (according to the current proposal) in taxes.

We will be watching carefully how it will unfold.

A hope message ❤️

I woke up early this morning here in Italy with a client's email, then a lot of msgs popping, and I still haven't got the proper time to study this new Circolare.

Let's rewind a bit: Last summer, the Italian Supreme Court gave a decision (nr.17161, June 15th) that limited the ability to receive dual citizenship, especially for US citizens.

The Supreme Court’s decision ruled that they would use another section of the law (Section 12, Law 555/1912) to limit this ability and have considered the ancestor receiving alternative citizenship to be renunciation for the Minor if it happened while the child's ancestor was still considered a Minor under law.

This year, another Italian Supreme Court decision went the same route. And now the Circolare, hence limiting the ability of dual citizenship recognition through consulates and in Italian municipalities, affects a lot of US citizens.

So, this has mostly been an issue in the courts in Rome since 2019/2020 or Palermo Court and, thankfully, other Regional Courts in Italy have continued to follow the much more favorable Section 7 (Law 555/1912).

Please remember that Italy adopts a CIVIL LAW system, so a Supreme Court case is not binding in Italy, strictly speaking. It does not set official legal precedent as it would in the US.

The LAW was not modified. Through the courts, this issue can be discussed. Hang in there! ❤️

I'm talking about the in Italy.🇮🇹

To those who hasn't heard about it or read about it, here are the main steps to take:

➡️Eligibility requirements: The Italian digital nomad visa is designed for highly skilled workers who are employed by a foreign company ( your company must be located outside of Italy and have no Italian facilities or offices) or freelancers with international clients. This means that your income must come from outside of Italy.

➡️Requirements to apply: have a valid passport, proof of employment or freelance work contracts (have worked for at least 6 months in the same industry), proof of sufficient financial resources to support yourself while in Italy (generally this means that you earn an annual remuneration of more than 28,000€), proof of residence (confirmed accommodations in Italy), and private health and medical insurance that covers the entire stay in Italy.

➡️Application process: you submit your Digital Nomad Visa application at your local Italian consulate (in your home country). Applicants, within 8 days in Italy, must file their Residence Permit Card (permesso di soggiorno) at the local Questura.

➡️Benefits: The Italian digital nomad visa allows you to live and work in Italy for one year , with the possibility of renewal (as long as the requirements are met).

⚠️ you'll be tax compliant in Italy
⚠️ Italy has a self employed visa as well. For DNV you'll need to prove you've been working as a freelancer/self employed digital nomad for the past 6 months (mininum).

🇮🇹Italian citizenship follows a system known as jus sanguinis (right of blood), which means citizenship is passed down through bloodlines, from parent to child.

🇮🇹When applying for Italian citizenship, as long as the line wasn't "broken", you don't need the generations before you to be recognized as Italian citizens in order to become a citizen.

But, what does this mean?
➡️It means that as long as the person who was "skipped" didn't renounce their right to citizenship (and by that breaking the line), or as long as the Italian ancestor and intervening generations never renounced Italian citizenship, it is passed down unimpeded.

So what does skipped mean?
➡️An easy way to think about it is that if your grandfather emigrated to U.S. and naturalized himself as a US citizen before your father was born (prior to 1992), this does not mean you can skip your grandfather's generation and use your great-grandfather as the Italian ancestor. This is because when your grandfather naturalized himself before your father's birth, the line was broken and your father was then born to an American citizen and not an Italian citizen.

✅ INAD: ATTIVATO L'INDICE NAZIONALE DEI DOMICILI DIGITALI DELLE PERSONE FISICHE 👉📧📧📧
In data 28 giugno 2023 il CNF ha comunicato a tutti i Consigli dell'Ordine l'avvenuta attivazione ad opera dell AgID (ossia l'Agenzia per l'Italia Digitale) dell'Indice Nazionale dei Domicili Digitali (INAD) delle persone fisiche, dei professionisti e degli altri enti di diritto privato non tenuti all'iscrizione in albi o registri professionali.
Nel comunicato si specifica che:
👉a) I domicili digitali presenti nell’INAD sono indirizzi elettronici “eletti”, validi ai fini delle comunicazioni elettroniche aventi valore legale;
👉b) essi, pertanto, sono validi ai fini delle notificazioni e delle comunicazioni degli atti in materia civile, penale, amministrativa, contabile e stragiudiziale nonché ai fini delle notificazioni in proprio tramite PEC degli avvocati, ai sensi dell’art 3-bis della Legge 21 gennaio 1994, n. 53
👉c) Nell’INAD, per gli Avvocati, l’indirizzo PEC professionale presente nel Registro INIPEC (Indice nazionale della posta elettronica certificata, previsto dall’art. 6-bis del CAD) sarà automaticamente inserito (per importazione), quale domicilio digitale personale predefinito degli Avvocati, salva la facoltà di eleggerne uno differente quale domicilio digitale delle persone fisiche;
👉d) i cittadini potranno, qualora lo riterranno, modificare e gestire il proprio domicilio digitale personale, avvalendosi delle funzioni del portale (in seguito sarà possibile anche tramite il portale dell’ANPR), eleggendo un domicilio digitale personale diverso da quello presente in INI-PEC; gli stessi avranno la facoltà di cessazione del domicilio digitale senza necessità della elezione di un nuovo domicilio digitale (facoltà che non sarà riconosciuta ai professionisti iscritti nell’INAD).

Constitutional Court, Sentence n. 195/2022, published on July 26th , 2022.
Up to now, the spouse of an Italian citizen who was applying for italian citizenship by marriage and remained widow/er during the application proceedings, had the acquisition of italian citizenship revoked.
HOWEVER, the Constitutional Court, through sentence n. 195/2022, published on July 26th, declared the constitutional illegitimacy of the rule - this means the application will go through, even though in the event of the death of the applicant's spouse. Also applies to civil union too.
Novidades reconhecimento da cidadania italiana por matrimônio:
Antes, o indivíduo que quisesse reconhecer a cidadania italiana pelo matrimônio (naturalização) , caso o/a cônjuge italiano/a falecesse durante o processo de reconhecimento da cidadania, este era revogado.
Até que, a publicação da sentença nº195/2022 ,em 26/07/2022 pela Corte Constitucional Italiana, declarou a ilegitimidade constitucional da regra - significando que, ainda que o cônjuge italiano/a faleça durante o processo de reconhecimento de cidadania italiana por matrimônio , o/a requerente terá seu processo continuado - válido tb para casos de união civil.
