Minneapolis Team Featured for their Pro Bono Work on Behalf of ICE Detainees, Almost All of Whom Have Been Released

Berger Montague represented more than 40 individuals detained during the ICE surge in the Twin Cities pro bono with habeas corpus petitions and filed a class action habeas case U.H.A. et al. v. Bondi et al., which challenged the illegal arrest and imprisonment of resettled refugees. Habeas corpus, Latin for ‘produce the body’, protects individuals from unlawful detention by requiring authorities to justify imprisonment before a court. The Court in the Bondi case issued a preliminary injunction, resulting in the proposed class being released from detention.

Today, a federal judge issued a Temporary Restraining Order (TRO) preventing the Trump administration from arresting and detaining lawfully resettled refugees in Minnesota under Operation PARRIS while the case challenging the practice proceeds.

The judge also ordered the immediate release of all detained refugees in Minnesota and the release of those taken to Texas within five days.

The TRO was granted as part of a class action lawsuit filed by a group of refugees represented by the International Refugee Assistance Project (IRAP), Berger Montague, and the Center for Human Rights and Constitutional Law (CHRCL). The Advocates for Human Rights, a non-profit providing on-the-ground legal representation to impacted refugees in Minnesota, is an organizational plaintiff.

“We are glad that the Court put a stop to ICE’s campaign of terror against our refugee neighbors. Today’s ruling is an important win, and a reminder that our courts are a powerful check,” said E. Berger Montague, a leading national plaintiffs’ law firm, has filed a class action against xAI’s chatbot Grok for creating large-scale unauthorized lewd and sexually abusive images of women and underage girls, which are published on Grok’s official account on the social media website X, formerly Twitter.

“xAI’s conduct is despicable and has harmed thousands of women and children who were digitally stripped and forced into sexual situations that they never consented to,” said Shareholder Sophia Rios. “This class action seeks relief for those harmed by xAI’s monetization of image-based abuse and harassment,” said Ms. Rios.

Last night, a group of refugees represented by the International Refugee Assistance Project (IRAP), Berger Montague, and the Center for Human Rights and Constitutional Law (CHRCL) filed a federal class action lawsuit challenging the illegal arrest and imprisonment of resettled refugees in Minnesota. Individual plaintiffs are lawfully resettled refugees who are not yet legal permanent residents. Many did apply for their green cards, but have been unable to receive them due to the Trump administration’s suspension of processing for refugees’ applications and long-standing processing delays. The Advocates for Human Rights, a non-profit providing on-the-ground legal representation to impacted refugees in Minnesota, is an organizational plaintiff.

“The victimization of refugees as part of a political payback is abhorrent. Refugees wait years to come to the United States, often to escape totalitarian regimes,” said Berger Montague Executive Shareholder E. Michelle Drake. “ICE is now behaving worse than the dictators from whom many of our clients escaped. ICE’s conduct is shameful and illegal, and we look forward to achieving justice in court.”

Berger Montague, a leading national plaintiffs’ law firm, has been working to file habeas corpus petitions on behalf of those unlawfully detained by Immigration and Customs Enforcement (ICE) in Minnesota. The Berger Montague Minneapolis team has been focusing its efforts on representing individuals impacted by the Department of Homeland Security’s (DHS) Post-Admission Refugee Reverification and Integrity Strengthening (PARRIS) initiative. PARRIS targets refugees.

In the immigration context, “refugee” is a legal term. It refers to someone who entered the United States legally, and only after being extensively vetted through background checks and biometric screening. Many people wait years, even decades, to have their request to enter the United States as refugees. Refugees are provided with work authorization and resettlement assistance and are supposed to receive green cards after one year. Operation PARRIS is now targeting all refugees in the United States who have not yet received their green cards.
