We were honored to represent the young man below this week and get a NOT GUILTY VERDICT in a STAND YOUR GROUND Case in Philadelphia Common Pleas Court.

My client along with a juvenile family member were meeting up at a city park to complete an online marketplace sale of sneakers and other designer clothing. The alleged buyer with an accomplice took the items at gunpoint. My client, who is lawfully licensed to carry a firearm in Philadelphia, was able to produce his firearm and defend himself and the juvenile in an exchange of gunfire. As a result of our investigation and pre trial practice, we were able to present an affirmative defense and achieve the right and JUST result. My client and his family were overcome with emotion when the NOT GUILTY VERDICT was recorded.

So it’s been a crazy week and a half, where do I begin……..

Well my client below (photo of him and his son posted with his permission) had a little harder time than me. Let me explain……

I am on the court appointment list. After a client is arrested it takes about two days for me to get notified that I am assigned. I don’t get a phone number for client just an address. Many times I don’t meet then until the day before the first listing of the case. My clients are given my phone number, and thanks to my client’s very persistent wife in this case, I was contacted last Friday about his case. He was arrested 4/17 and his court date wasn’t until 5/2. He was being held on $250,000 bail for a very serious charge of carjacking. He has no convictions and works full time as a janitor to support his family…

At around 230 pm last Friday I spoke with his wife who informed me there is no way my client was guilty of this crime…. He was a my work and then picking up his son at the other end of the city when this alleged crime happened. She told me there is absolutely video to prove it. So the journey began. Trying to preserve and get actual possession of evidence like this takes a ton time when you are not in law enforcement. I immediately began calls and drafting emails and letters to his work, his son’s school, septa….. around 10’pm I finally had gathered enough information to email the DAs Office confidently that the wrong man had been arrested.

Late Monday night the Das Office responded and I must say was very receptive to the evidence I gathered. They immediately agreed to house arrest and to further investigate his case. Within 24 hours they knew what we were telling them was true. Steps were then taken to have the charges withdrawn and my client released. Unfortunately that didn’t happen until 630 last night. 8 days later…. 6 work days later… he sat in prison for a crime he had nothing to do with…

We are grateful our office was able to gather the information needed so the DAs Office could act swiftly in withdrawing these charges. Every
minute he was incarcerated was nerve racking!

So HAPPY FRIDAY! I am looking forward to spending the weekend with my family as I am sure the two in the pic below are! The system works if you have the right people on your side to do the difficult work that needs to be done. I am so grateful I was assigned his case and to this wonderful family.
