New Settlement Alert at jury selection. We secured $6,150,000.00 and a waiver of a $300,000 workers’ compensation lien: Partners Daniel Leav, Edward Steinberg, and Daniela Henriques all collaborated over four and a half years to represent a now sixty-eight-year-old man who was struck by a caisson that sent him airborne, causing him to sustain bodily injuries, including a traumatic brain injury, a knee tear requiring surgery, and spinal injuries.

The case was “won at the intake,” with Mr. Steinberg and Ms. Henriques securing the necessary investigation to prove that this accident occurred because of negligence and the failure of the job site to be set up safely. The case was then developed by Daniel, Edward, and Daniela, who handled various aspects of discovery, ultimately securing summary judgment on liability.

Mr. Steinberg attended two failed mediations, and the matter was then set for trial, at which point Mr. Leav prepared the client and our experts over the last month.

At jury selection, Mr. Steinberg and Mr. Leav attended and, with the help of the court, secured 100% justice and the dignity our client deserves.

From $25,000 to $1,650,000. Our client, a young man, was nearly killed in a violent crash in Brooklyn—it looked like there would be little to no recovery. He was riding as a passenger on the back of an uninsured motorcycle when a drunk driver sped through an intersection and T-boned the bike. The impact threw him onto the pavement, leaving him with devastating injuries to his shoulders, neck, back, and liver—requiring emergency surgeries and intensive medical care.

At first, the case seemed limited to just $25,000—the minimum insurance coverage carried by the drunk driver. Even after identifying all available primary policies, the total recovery appeared capped at $50,000. For most, that’s where the case would have ended. Attorney Justin White refused to accept that outcome. Through a deeper investigation into the vehicle owner and all potential sources of coverage, he uncovered a previously undisclosed umbrella policy tied to the owner’s employer. That discovery transformed the case.

New Settlement Alert ⚖️
Attorneys Robert Rose, Esq. and Edward Steinberg, Esq. secured a $3,250,000 settlement less than three weeks before the scheduled trial.

Robert Rose handled litigation from the very first filing, including pleadings, depositions and trial preparation including hiring 6 experts ranging from medical doctors, meteorologists, life care planners and economists. When the defense finally saw what was coming at trial, they got serious.

The defense had two arguments: the fall never happened, and the injuries weren’t related to it. They were proven wrong on both counts.

Our client suffered serious spinal injuries requiring spinal surgery and a revision surgery. The defense leaned hard on the fact that the first surgery came years after the accident, arguing there was no connection. Our expert medical team dug into the records, traced the progression, and dismantled that argument completely.

As for the fall itself — we slowed the surveillance footage down, annotated every frame, and made it impossible to dispute. You can see the exact moment the foot gives way on an icy, neglected sidewalk. The defense had no answer for it.

After years of lowball offers, the defense finally got serious when we delivered the expert team and video footage. Robert Rose and Edward Steinberg attended mediation together and fought for every dollar.
