Mental health conditions like depression are often misunderstood in the workplace, but under New York law they can qualify as a protected disability. If you’re pregnant and working, you are in a federally protected class - and most employers either don’t know it or are hoping you don’t. The Pregnant Workers Fairness Act of 2023 requires your employer to reasonably accommodate you throughout your entire pregnancy. Morning sickness, orthopedic issues, bladder pressure on your commute - those are accommodations they must provide. Docking your pay or writing you up for using those accommodations? Unlawful. Put your pregnancy in writing to HR before you’re showing. That email creates the paper trail that proves exactly when your protected status was invoked - so if your boss then says “I thought your shop was closed” or “how many more babies are you planning,” you’ve got the receipts. You’ve got rights. Know them. Exercise them.

Perimenopause and menopause symptoms are intersectionally protected in the American workplace right now - under the ADA, Title VII, and the ADEA. Age, s*x, and disability. All three at once. You cannot be managed out the door for your symptoms. You cannot be retaliated against for asking for accommodations. Laws are coming. But you don’t have to wait. A law you don’t know about is a law you can’t use. And a right you don’t raise is a right you don’t have.
