Legal custody and physical custody are not the same thing, and understanding the difference can change everything.

Legal custody refers to decision making power. It is about who has the authority to make major choices for your child, including education, healthcare, religion, and overall welfare.

Physical custody is about where the child lives. It determines daily routines, meals, school drop offs, bedtime, and the time each parent spends with the child.

In most Pennsylvania cases, courts award joint legal custody. That means both parents share the responsibility of making major life decisions, even if the child lives primarily with one parent.

Physical custody, on the other hand, can take different forms. It may be shared between both parents, primarily held by one parent, or arranged as partial custody or visitation for the other.

In rare cases, one parent may be awarded sole legal or sole physical custody. This usually happens when the other parent is absent, unfit, or there is a history of abuse. Supervised visitation may also be ordered.

Pennsylvania only recognizes DUI, which stands for driving under the influence. DWI, or driving while intoxicated, is simply what other states call the same offense.

What you really need to remember is the legal limit. In Pennsylvania, driving with a blood alcohol content of 0.08 or higher can lead to a DUI charge.

What really happens after you are arrested in Pennsylvania?

Most people only see the handcuffs and the ride to the station, but the process that follows can shape the rest of your life.

It begins the moment you are taken into custody. Anything you say or do can be used against you, which is why staying silent and asking for a lawyer is the smartest first move.

Next comes booking, where your information, fingerprints, and mugshot are collected.

Even if your charges are later dropped, this step creates a permanent record.

From there, charges are officially filed. In Pennsylvania, this is usually done by the police, but in more serious cases, the District Attorney steps in to review.

Then bail is determined. A judge will decide whether you are released on your own recognizance, given conditions, or held, based on your record and the charges you face.
