It's World Backup Day.

In today’s digital world, data is not just information – it is evidence, strategy, communication, and, in many cases, the backbone of your legal rights and responsibilities. Each year on March 31, World Backup Day serves as a timely reminder of a simple but critical practice: backing up your data.

At Omnis Law Group, we have seen firsthand how the loss of digital information can create significant legal, financial, and personal challenges. Whether you are an individual, a business owner, or a professional, protecting your data is no longer optional – it is essential.

Data loss can occur in an instant due to hardware failure, cyberattacks (including ransomware), accidental deletion, intentional malicious deletion, theft or loss of devices, and natural disasters. For individuals, this may mean losing irreplaceable personal records, photographs, or financial documents. For businesses, the consequences can be far more severe: lost client files, disrupted operations, and potential legal exposure. From a legal perspective, the inability to produce key documents can affect everything from contract disputes to criminal defense matters. In some cases, missing data can weaken a claim or defense entirely.

Failing to preserve important records can have serious consequences, including: spoliation issues in litigation, inability to comply with discovery obligations, exposure to sanctions or adverse inferences, loss of critical evidence in criminal or civil matters. Courts increasingly expect parties to maintain and produce electronically stored information. A lack of proper data backup practices can quickly become a legal liability.

World Backup Day is the perfect opportunity to review your backup strategy or to implement a reliable backup strategy if you don’t currently have one. When assessing a backup strategy, consider the following best practices:

Follow the 3-2-1 Rule
Keep 3 copies of your data, on 2 different types of storage (e.g., external drive and cloud), with at least 1 copy stored offsite.
Use Secure Cloud Storage
Cloud-based solutions provide accessibility and redundancy. Be sure to choose a reputable provider with strong encryption and security protocols.
Automate Your Backups
Manual backups are easy to forget. Automated systems ensure your data is consistently protected without relying on memory.
Regularly Test Your Backups
A backup is only useful if it works. Periodically verify that your files can be restored successfully.
Protect Sensitive Information
For law firms, businesses, and individuals handling confidential information, encryption and secure storage are critical to maintaining privacy and complying with legal obligations.

Businesses, especially those handling sensitive client information, should take additional precautions including developing a formal data retention and backup policy, training employees on cybersecurity awareness, ensuring compliance with applicable privacy laws and regulations, and maintaining secure backups of client communications and records. For legal professionals, safeguarding client data is not just good practice, it is part of your ethical responsibility set forth in the Rules of Professional Conduct.

While backing up data is primarily a technical task, the legal consequences of failing to do so can be significant. At Omnis Law Group, we assist clients in navigating issues related to:

Data loss and its legal ramifications
Evidence preservation and discovery obligations
Cybersecurity-related legal concerns
Business risk mitigation and compliance

Take Action Today! World Backup Day is more than a reminder, it is a call to action. Take a few moments today to evaluate your current backup practices. Ensure your important files, records, and communications are secure, accessible, and protected against unexpected loss.

If you have questions about how data preservation may impact your legal rights or obligations, Omnis Law Group is here to help. Put over 80 years of Aggressive • Professional • Experienced attorneys to work for you.

New Year’s Eve is a time for celebration, but it’s also one of the most dangerous nights of the year on the roads. The combination of alcohol, late-night festivities, and increased traffic can lead to tragic consequences for those who choose to drink and drive.

Driving under the influence puts not only your life at risk but also the lives of everyone else on the road. A single poor decision can result in severe injuries, loss of life, and lasting emotional trauma for everyone involved. Beyond the immediate physical dangers, the legal and financial repercussions of a DUI are staggering. Attorney fees, court costs, and skyrocketing insurance premiums can quickly exceed thousands of dollars. Instead of risking it all, plan ahead:

Use a Designated Driver: Arrange for a sober friend or family member to take the wheel. Call a Ride Service: A rideshare or taxi is a small price to pay for peace of mind. Stay Over: If you’re celebrating away from home, plan to spend the night. The cost of a designated driver or rideshare is far less than the legal fees and penalties of a DUI—not to mention the human cost of causing harm to yourself or others.

If the unexpected happens and you find yourself in legal trouble, Omnis Law Group is here to help. Our experienced attorneys understand the complexities of DUI cases and are ready to fight for your rights. Contact us to schedule a FREE consultation.

Let’s make this New Year’s Eve a celebration to remember—for all the right reasons. Stay safe, plan ahead, and don’t drink and drive.

11/14/2024

In Pennsylvania, the rules surrounding ma*****na use and driving can be complicated, particularly for those who legally possess and use ma*****na through the state’s Medical Ma*****na Program. Though Pennsylvania has made it legal for registered patients to possess and use ma*****na for approved medical conditions, legal patients still face challenges when driving or even simply transporting their prescribed ma*****na.

One key issue for medical ma*****na patients is Driving Under the Influence (DUI) charges. Pennsylvania’s DUI laws remain strict on controlled substances, including Tetrahydrocannabinol (THC), the active compound in ma*****na. This means that even if a person is not exhibiting signs of impairment, they can still be charged with DUI if they have THC in their system. This places medical ma*****na users in a difficult position: they may use their medication responsibly but still face legal risks if they drive while THC is in their bloodstream. THC can remain detectable in the body for days or even weeks, far beyond the period when its impairing effects wear off. However, Pennsylvania law does not yet distinguish between active impairment and the mere presence of THC in the bloodstream, unlike some other states. This puts patients in a position where they could be deemed legally “under the influence” without actually being impaired from a toxicological perspective.

It is also important to store medical ma*****na in its original, labeled container while traveling, as possession in a different container can lead to complications if stopped by law enforcement. Even with a valid medical ma*****na card, transporting ma*****na in anything but its original prescription container can raise suspicions and potentially complicate a legal defense. Unlike an out-of-state Driver’s License, Pennsylvania does not currently recognize out-of-state medical ma*****na cards. Therefore, even if someone is a registered medical ma*****na patient in another state, possession of ma*****na without a Pennsylvania card can lead to charges. This discrepancy between state laws often surprises out-of-state patients who may mistakenly assume that their medical ma*****na status will be respected across state lines.

As Pennsylvania continues to develop its policies on ma*****na use and driving, patients and legal users should take precautions. If you are a medical ma*****na patient in Pennsylvania, avoid driving while THC might still be in your system and always transport your medication in its original container. And if you are visiting Pennsylvania from another state where you legally use ma*****na – medical or recreational – be aware that possessing it in Pennsylvania without a Pennsylvania medical card could lead to legal trouble. Always stay informed and consider consulting a legal professional if you have questions about your rights and responsibilities as a medical ma*****na user in Pennsylvania.

Here in Pennsylvania and across the nation, veterans carry a legacy of courage and dedication that lives on in every one of us. As we mark this Veterans Day, let us remember that their bravery has shaped the foundation of our society. We encourage everyone to take a moment to thank a veteran, visit a local memorial, or participate in an event honoring their contributions.
At Omnis Law Group, we are committed to standing by those who serve, not only today but every day. We are grateful for our veterans and their families, whose sacrifices continue to protect our freedoms and uphold the American way of life. This Veterans Day, we express our deepest appreciation for our nation’s veterans and renew our pledge to honor their service in all that we do.

Letting your emotions get the better of you is just not worth the aggravation caused.

As Election Day approaches, it’s common to see political signs on private property, expressing support for various candidates or causes. Unfortunately, in recent weeks, there have been numerous reports and videos circulating of people damaging or removing election signs from yards and other private property. In Pennsylvania, this is not only disrespectful but illegal, and those caught engaging in such behavior could face serious consequences.

Under Pennsylvania law, damaging or removing election signs can result in charges of theft by unlawful taking, criminal trespass, or criminal mischief, all of which carry the for potential fines or even jail time. Property owners have the right to express their political views on their land, and interfering with this right is a violation of both property and free speech protections. It is important for everyone to understand that taking or defacing these signs is not only a poor reflection on one’s character but can lead to costly legal troubles.

In our Constitutional Republic, differing opinions are not only expected, but healthy. We do not all have to agree on politics, but we must respect each other's right to express their views. Tolerance for differing points of view is the cornerstone of a civil society, and resorting to vandalism or theft only serves to diminish that principle.

As we move further into election season, let’s remember that we all play a part in ensuring a respectful and lawful process. Let’s promote healthy debate, engage in civil discourse, and remember that every citizen has the right to their opinion, even if it differs from our own.
