Grandparents play a vital role in children’s lives, but when do they have legal standing to ask for custody or visitation in PA?

Under 23 Pa.C.S. § 5324 & § 5325, Grandparents MAY petition for partial custody or visitation under specific circumstances:

1. When the child’s parents have been separated for 6+ months or filed for divorce.
2. When the child resided with the grandparent for 12+ consecutive months.
3. When the grandparent stepped in to protect the child from abuse, neglect, or substance issues (In Loco Parentis).

The court balances the grandparent bond with the natural parents’ constitutional rights.

Questions about grandparent custody in Delco? Contact Jones & Associates, Law P.C. at (610) 874-1900.

Thinking about relocating to another state or distant county with your child without court authorization? In Pennsylvania, unapproved moves can severely impact your custody rights!

Under PA Custody Law (23 Pa.C.S. § 5337):

• You CANNOT relocate if the move significantly impairs the non-relocating parent’s ability to exercise custody, unless you provide formal legal notice AND obtain court approval or consent.
• Moving without proper notice can result in an emergency court order directing the child’s return and modifying physical custody.

Relocation matters require strict procedural steps. Call Jones & Associates, Law P.C. at (610) 874-1900 before making moving arrangements.

In Pennsylvania child custody disputes, judges do not pick favorites. Under PA law (23 Pa.C.S. § 5328), courts must evaluate specific Statutory Custody Factors to determine the “Best Interests of the Child”!

Top factors judges weigh heavily:

1. Child Safety & Protection: Evidence of abuse or risk of harm.
2. Parental Duties: Who historically handles daily routines, doctor appointments, and schoolwork?
3. Need for Stability: Maintaining continuity in school, community, and family life.
4. Level of Cooperation: Which parent encourages ongoing contact with the co-parent (when safe)?

Building your custody case around these statutory factors, not emotional arguments, wins in court!

Need a custody strategy aligned with PA law? Call Jones & Associates, Law P.C. at (610) 874-1900.

Spousal Support,” “Alimony Pendente Lite (APL),” and “Alimony” sound like the same thing, but in PA divorce law, timing is everything! ⏱️

Here is the breakdown:

1. Spousal Support: Paid before a divorce complaint is filed when spouses are living separate and apart.
2. Alimony Pendente Lite (APL): Paid during active divorce proceedings to ensure both parties have equal financial resources to litigate.
3. Alimony: Secondary support awarded after the divorce decree is finalized based on 17 economic factors.

Understanding which type applies to your situation impacts your financial strategy!
