In a case of first impression, Vaziri Law LLC was recently successful in arguing before the Third District Appellate Court that the government contractor exemption in the Illinois Biometric Information Privacy Act does not cloak an entity’s entire operation simply because it possesses a government contract. The panel held, “Read completely, the exclusion exempts government contractors at the time they are serving a state agency or local government unit, the panel said. As such, they are exempt from BIPA's requirements when they are operating within the scope of their contractual relationship with the government, it held. And conversely, "a government contractor is not exempt when it violates the act while pursuing private undertakings outside of its government contractual responsibilities," the panel said. Last week, the Seventh Circuit Court of Appeals reversed the trial court’s grant of summary judgment for defendant and against our client in a common law retaliatory discharge case. We were confident the trial court got it wrong and appreciate the appellate court agreed.

Our work is not easy, and despite our adversarial system, I have tremendous respect for the skill of my counterparts on the other side of the “v.” It keeps me on my toes and constantly wanting to improve. So, I don’t take any positive outcome for granted, and each one is so gratifying. Looking forward to presenting the case to a jury.

On March 6, 2026, the First District Appellate Court affirmed our bench trial victory in its entirety in a breach of contract case. Directed finding of no liability as to Defendants’ counterclaims for breach of contract and breach of fiduciary duty affirmed. Judgment in favor of Plaintiff affirmed. Award of attorney’s fees and costs affirmed. What started as a dispute over a relatively modest sum has now resulted in hundreds of thousands of dollars owed. The wheels of justice move slowly, but the wait is worth it when the outcome is just.

When the office first opened, I really emphasized networking and made sure we maintained our online presence. Because of how busy the office has been, I have not done a great job on those fronts in the recent past.

No better way to pick back up on those efforts than by announcing that at a recent bench trial, we obtained a judgment in our President & Chief Operating Officer client’s favor for $1.5M in a wage payment violation case.

Sadly, our client passed during the pendency of the case, and his wife continued the litigation on behalf of his estate. His passing made the trial more difficult, because we were left to prove our case essentially by cross-examination of the employer. But we did. After trial, his wife and I talked about how much we wished he could have seen the end result and that justice was served. I’d like to think somehow he has.

Great way to bring the year to a close, and rest assured you will hear from me in 2026 to grab coffee, lunch, or a drink!

Vaziri Law LLC recently represented our law firm client in a breach of contract case arising from an attorney-client relationship that soured and resulted in significant unpaid attorney’s fees. The Defendants filed affirmative defenses and counterclaims against our client alleging fraud, breach of contract, and breach of fiduciary duty. These were serious allegations that we did not take lightly. In most professions, but especially in the legal sphere, maintaining a reputation of integrity is everything. Years of litigation culminated in a three day bench-trial. We always knew we were in the right, and the Court agreed—a directed finding against Defendants on all of their counterclaims and a finding in Plaintiff’s favor on our breach of contract claim. Our client was delighted that its reputation remained untarnished—and we took great pride in achieving that outcome for them.
