On Monday, the Parliament has finally gazetted the much-needed amendment, making a significant impact on the welfare of employees! 📣📣📣

The Employment (Amendment of First Schedule) Order 2022 will come into effect on 1 September 2022 alongside with the Employment (Amendment) Act 2022.

With the updated First Schedule, the Employment Act 1955 (“the Act”) has now extended its coverage to all employees who have entered into a contract of service in Malaysia and no longer confine to those who earn RM2,000 and below.

However, certain provisions in the Act are still subject to the increased salary threshold of RM4,000 a month. Employees earning above RM4,000.00 will still need to refer to their respective employment contracts for the overtime and termination benefits.

Note 💡 All employers are expected to immediately review your existing employment contracts, Employee Handbooks and policies to ensure due compliance with the Act.

Flexible Working Arrangements (FWAs) will officially take effect on 1 September 2022.

With the latest announcement, employers especially SMEs may face challenges in managing and implementing FWAs. In the absence of clear guidelines from the government regarding the process of the FWAs, employers are free to adopt any FWAs policy to serve as a guide for managing the employees effectively. E.g. the types of work arrangements, suitability, performance evaluation, remuneration and other operation details.

All FWAs applications must be made in writing and the employer must give an answer to the employee in writing on whether they accept or reject the application within 60 days with reasons if the application is rejected.

The Employment (Amendment) Act 2022 merely states that FWAs may vary the hours of work, days of work or place of employment but is silent on the types of FWAs. Generally, it may consist of the following.

It has been a harsh reality of life that many newborn children left abandoned near dumpsites, baby hatches, public toilets, places of worship and so forth.

The recent Federal Court's decision is now served as a guidance for the NRD and the Registrar-General of Births and Deaths to deal with abandoned newborn children when their biological parents could not be traced.

We are expanding!

The firm is proud to announce the admission of Esther Foo as a partner of KK Tan & Partners effective June 2022.

Esther holds a Bachelor of Law (Hons) from Multimedia University and started her legal career in one of the leading mid-sized law firms in Malaysia. Esther was admitted as an Advocate and Solicitor of the High Court of Malaysia in June 2017.

Prior to joining KK & Partners, Esther practised in Kevin & Co. a boutique litigation firm where she gained experience in dispute resolution while honing her skills in the profession. Esther involves in a wide range of general and commercial litigation, brings along with her experience in matters related to contractual and commercial disputes, employment disputes, strata disputes, landlord and tenancy, defamation, insolvency matters, tort, real estate and family law.

Being a solution-oriented person, Esther is extremely grounded and would often go extra miles listening to clients and providing recommendations for actions that cover different possible outcomes. We are certain that she is a valuable addition to the team.

A large increase in the volume of our workload has made it necessary to expand our team to meet these demands. It is with great pleasure that we announce the appointment of CM Chiew as our new partner!

Chiew is an LLB graduate of Universiti Utara Malaysia (UUM) and an LLM graduate of Universiti Malaya (UM). Chiew’s practice areas are civil litigation and conveyancing. He gained significant exposure and experience in legal practice involving construction law, commercial cases, arbitration, defamation, public interest litigation, as well as criminal cases.

Chiew is a firm believer in social justice and equality. He is active in movements for these
causes. He is also actively involved in social activities such as charity and awareness campaigns.

We are confident that his experience and expertise will add great value to our firm and lead us to greater success.
