The Communications and Multimedia Content Forum of Malaysia (Content Forum) has called for public consultation on the proposed Influencer Guidelines 2026, marking an important development in Malaysia’s evolving digital and advertising landscape.

Under Section 8A(1) of the Printing Presses and Publications Act 1984, maliciously publishing false news is an offence that applies to EVERYONE, not just journalists or traditional media outlets!

🚨 BEWARE: Your online posts or messages could become "EXHIBIT A"! 🚨

Think deleting a post or a live stream saves you from a defamation suit? Think again! 📱⚡

Under Section 3 of the Defamation Act 1957, broadcasting words through telecommunications is treated as libel (publication in a permanent form). Even if you delete the content later, the act of publishing it to a third party has already occurred.

⚖️ Case Highlight: Teresa Kok Suh Sim v. Jamal bin Mohd Yunos [[2022] MLJU 2440]

Facts: The defendant held a press conference falsely claiming the plaintiff had misappropriated nearly RM2,000,000 from the Yayasan Warisan Anak Selangor welfare fund for personal use. The statements were broadcasted live on Facebook and YouTube, and later republished.

The Ruling: The court applied Section 3 of the Defamation Act, ruling that online publications are considered permanent form.

🔍 To prove online defamation, a plaintiff must establish:
1. The statement bears defamatory imputations.

2. The statement refers to the plaintiff.

3. The statement was published to a third party by the defendant.
