Lapsed Appeal - On the Day!

We often get asked if the DWP will make changes to a decision / concede an award before an appeal hearing.

Whilst in most cases, this tends to happen early in the appeal process, after an appeal has been lodged with the tribunal, it can happen at ANY time before an appeal hearing.

Today our Senior Lawyer, Chris, has been scheduled to represent a Claimant at a tribunal hearing. However, he has just taken a call from the tribunal clerk confirming that a Presenting Officer (a DWP representative) has conceded the award, to the full rate that we requested within our submissions.

Fantastic news for the Claimant, who will now not have to take part in a tribunal hearing.

MEET THE TEAM

Today, we meet Teresa, a Disability Advocate at PIPP Support Group.

Let's see what Tersa says about herself:

"I was a teenage care leaver and now have six children, each diagnosed with various disabling conditions. I have firsthand experience with different neurodivergences and mental health issues. In 2010, I founded and continue to run a large online support group specifically for autism, based in Scotland. My background includes work in mental health, social care, and publishing. Currently, I am studying for a BA (Hons) in Law with The Open University alongside my role as disability advocate. On a personal level, I live with inflammatory arthritis, a hearing impairment and ME/CFS. Balancing my role as a carer for my children, while managing chronic pain and fatigue, allows me to relate to the anxieties many people face when applying for disability benefits. Given my life experiences, I am deeply passionate about social justice and welfare rights. I understand that the application process can be overwhelming, and I am here to help alleviate as much of that stress as possible."

Yesterday we were successful in another appeal hearing where the claimant was not asked any questions by the Panel.

They made their decisions before the hearing stated, based on our submissions and the evidence.

The Judge thanked our Senior Lawyer the carefully written submission and relevant information provided.

RELIABILITY CRITERIA) in relation to PIP
In this series of posts, we are providing information about what the assessors, DWP and any Panel at
an Appeal will be considering.
The way an activity is undertaken by a Claimant should always be:
• Safely
• To an acceptable standard
• Repeatedly
• In a reasonable time
TO A REASONABLE STANDARD
They must be performed to an acceptable standard. This means that the task must be done to a standard
that would reasonably be acceptable to most people.

Have you been awarded LCW/WRAG but not been awarded the correct rates of PIP?
If so, call the DWP and ask for a copy of your ESA/UC85 assessment report. This is the long report written by the assessor during your work capability assessment. This will contain an example of your ‘typical day’ and may be very supportive evidence.
The DWP may have also written to your GP to ask for information. When you call them, ask if they have an ESA/UC113 form on file for you. This is the GP factual report.
We often find that both or either of these can be helpful for your appeal.
