But what were the rules when your family arrived?

In 1790, U.S. naturalization law limited citizenship to “free white persons.” In 1882, the Chinese Exclusion Act specifically restricted Chinese immigration.

Meanwhile, for much of the 1800s, many European immigrants entered the United States without facing today’s system of visas, numerical limits, and years-long waiting lists.

Immigration laws have never affected everyone equally.

Before comparing today’s immigrants to our ancestors, we should also compare the laws they faced.

BREAKING: USCIS just changed the affirmative asylum process.

Under a new rule, asylum officers may now refer certain asylum cases directly to Immigration Court without first conducting an asylum interview.

That means your written application, personal declaration, and supporting evidence are now more important than ever. In some cases, applicants may never have the opportunity to explain their story during an interview before being placed in removal proceedings.

If you have a pending asylum application—or you’re planning to file one—this change could significantly impact your case.

Not every tragedy begins with a crime. Some begin when a mother begs not to be separated from her child.

According to reports published by The Washington Post, Wendi Hernandez Reyes said she asked to be deported together with her young son, but that request was not granted. Months later, her 3-year-old son, Orlin, who had remained in the United States in the care of an uncle, died after suffering severe abuse. Authorities have charged the uncle with his murder, and forensic examinations also indicated signs of sexual abuse. The case continues to receive widespread public attention.

Regardless of the political debate surrounding immigration, one question remains:

When a child is left unprotected, who is held accountable?

As an immigration attorney, I see every day how decisions made during the immigration process can change lives forever. That is why every case must be handled with responsibility, humanity, and respect for due process.

The Constitution does not stop at the border, and it does not disappear during an immigration arrest.

A video showing an ICE agent slamming a person’s face onto the concrete and allegedly threatening a bystander with a Taser for recording raises serious constitutional and civil rights concerns. If these events occurred as shown, they deserve a thorough, independent investigation and accountability.

No one is above the law. Respect for public safety and respect for constitutional rights must go hand in hand.

Every person in the United States—regardless of immigration status—is entitled to due process and protection against excessive force under the law.
