"I was partly at fault for my accident. Do I still have a case?"

Yes. Florida uses modified comparative negligence. If you're less than 51 percent at fault, you can still recover damages, your payout just gets reduced by your percentage of fault.

So if you were 20 percent at fault and your damages are $100,000, you can still recover $80,000. Don't assume partial fault means no case, talk to an attorney first.

If you're ever in a car accident, the first 10 minutes matter.
Check for injuries and call 911. Get to safety if you can. Take photos of both cars, the road, and your injuries. Get the other driver's name, insurance, and plate, and grab witness info too. Don't say sorry, don't say you're fine, just exchange info and let the police handle the rest.

Two days after your accident, the other driver's insurance company calls. Sounds friendly. Asks if they can record a quick statement.

Don't do it. That call isn't friendly, it's evidence collection. They're trained to get you to say things like "I'm fine" or "it happened fast" that they will use against you later to deny or lower your claim.

You have zero obligation to give them a recorded statement. None. If they call, tell them to talk to your attorney.

Myth: the police report decides who's at fault in your accident.

False. A police report is not evidence, and it is definitely not the final word. Officers can make mistakes, they weren't there when it happened, and fault under Florida law comes down to the actual facts, not just a box someone checked.

I've had cases where the report said one thing and the evidence proved another. Don't let an adjuster tell you the report ends the conversation. It's where it starts.

Check for injuries and call 911 if anyone is hurt
Take photos of the scene before anything moves
Get the other driver's info and any witness contacts
See a doctor even if you feel fine, injuries do not always show up right away
Talk to a Florida injury attorney before you talk to any insurance company

Got hurt in an accident while visiting Florida? Here's what most people don't realize.

Florida law governs your claim, not the law in your home state. That means you need a Florida injury attorney (bonus points if it's one who understands how insurance companies build their defense because they defended insurance companies in court for years).

You can treat for your injuries back home. Your attorney handles the claim here in Florida while you recover. Most of the process can be done remotely. Down the road, something like a medical exam or trial could require a trip back, but that is far down the road and rare.

This week's Quick Question, Jake: Next Level Water Pollos' top dawg Jack asks what to do if he gets into a fender bender in the school parking lot.

My answer...
(1) Get the other driver's name, insurance, and plate.
(2) Photos of everything before cars move.
(3) Call your parents, then call 911, even for something minor.
(4) Don't say sorry, don't say it was your fault.
(5) And don't talk to insurance without a parent or a lawyer in the room.
