President Biden has made it much harder for ICE to arrest undocumented persons appearing in court. Previously, you could be arrested by ICE for showing up to pay a No Valid Driver License ticket, or even for testifying in a case.
Now, DHS (ICE) has stated that "arrests in or near courthouses will only be permitted if (1) it involves a national security matter, (2) there is an imminent risk of death, violence, or physical harm to any person, (3) it involves hot pursuit of an individual who poses a threat to public safety, or (4) there is an imminent risk of destruction of evidence material to a criminal case."
This is great news but remember! being a defendant, witness, or victim in court can still affect your immigration status. If you have any questions or concerns, please give us a call at (813) 595-0066.

The decision rolls back a Trump administration practice of seizing people who were in courthouses for reasons unrelated to their immigration status.
