Greg here - Memorial Day weekend is here, and DUI patrols will be everywhere across Washington. If you’re out with friends or family this weekend, please plan ahead before you get behind the wheel.

Call a rideshare. Hand over the keys. Crash on a friend’s couch. Just don’t risk it.

Saad, can a child request to be legally separated from their parents?

Yes, emancipation is a legal proceeding that, like a divorce, legally separates young people from their parents before they reach the legal age of majority in their state. After a court order gets you emancipated, parental consent is not required for anything.

Greg, can you explain this DUI saliva testing?

Yes, I can - under one new statute – RCW 46.61.5062 – law enforcement agents can now use oral fluid (i.e. saliva) testing devices during DUI stops. Unlike handheld breath test devices, which test for alcohol, these portable oral testing devices test for the presence of drugs in a driver’s saliva.

May the Fourth Be With You… and Your Intellectual Property Strategy

Before Star Wars became a cultural phenomenon, Ideal Toy Company passed on the chance to produce official merchandise, calling sci-fi “chancy” and the film “ordinary.”

Then came the box office explosion.

Suddenly reconsidering, Ideal launched its own sci-fi toy line “Star Team” featuring characters like the “Knight of Darkness” (definitely not Darth Vader 👀) and robot sidekicks reminiscent of R2-D2 and C-3PO.

Not amused, Kenner Products—the official Star Wars licensee—took them to court over trademark and copyright infringement.

Here’s the twist:
Even though 65% of kids associated the toys with Star Wars, the court said that’s not enough. Association ≠ confusion. Just because something reminds you of a galaxy far, far away doesn’t mean consumers believe it’s officially licensed.

The takeaway:
In IP law, inspiration has limits, but “vibes” alone don’t win infringement cases.

In Seattle, there are currently more than 5,000 unfiled misdemeanor and gross misdemeanor criminal cases. Just under 3,000 of those backlogged cases involve alleged crimes of domestic violence, elder and child abuse, assaults with sexual motivation, stalking and criminal traffic cases, including DUIs.

A few weeks back the Washington State Senate moved to reduce DUI lab delays by permitting certified private laboratories to test blood samples, which, in turn, would relieve the pressure on the Washington State Patrol toxicology laboratory from having to handle the testing of all of the State’s blood samples.

If passed, SB 5880 would allow local jurisdictions to contract with accredited private laboratories to test blood samples obtained by law enforcement.
