Immigration Update (USCIS / DHS – May 2026)

On May 22, 2026, USCIS issued a memo suggesting that immigrants seeking green cards would generally be expected to apply from outside the United States through a U.S. embassy or consulate, except in extraordinary circumstances.

However, on May 29, 2026, DHS clarified the guidance, stating: “Actually, most immigrants won’t need to leave the U.S. to get green cards.” Officials explained that the memo was not a new rule, but rather a reminder of existing discretionary authority that immigration officers already have.

DHS further emphasized that green card decisions will continue to be made on a case-by-case basis, not through any blanket policy requiring departure from the United States.

A senior White House official also described the guidance as a “housekeeping matter, not a change of strategy.”

Who may be affected by the new USCIS Adjustment of Status policy?

USCIS is increasing scrutiny on certain Adjustment of Status (I-485) cases under its new memo giving officers broader discretionary authority during case review.

Cases that may face closer review include applicants with status violations, visa overstays, weak documentation, criminal history, RFEs, or other adverse discretionary factors.
