My client was facing a federal charge under 8 U.S.C. § 1324. After reviewing the evidence, I presented the government with both factual issues in its case and mitigating information regarding my client and the circumstances surrounding the offense.

Following those discussions, I was able to convince the government to dismiss the case entirely.

The result: no conviction and no further prosecution.

CASE DISMISSED.

My client was charged with assault with a semi-automatic fi***rm (PC 245(b)) and criminal threats (PC 422).

The criminal threats charge was dismissed at the preliminary hearing. The court later granted our motion for mental health diversion, and after my client successfully completed the program, the entire case was dismissed.

A great result and an opportunity for my client to move forward.

I’ve been getting a lot of calls from people interested in restoring their gun rights after hearing about the recent announcement from the federal government. Even if the federal government were to grant your application, that is not going to be enough. While it may restore your federal gun rights, it doesn’t restore your rights under state law. Extra steps will need to be taken to restore those rights under state law.

For example, if you have a felony conviction for a state law offense, you can still be charged with being a felon in possession of a fi***rm. If your prior felony conviction is eligible, you will need to have it reduced to a misdemeanor. For most cases, this will restore your fi***rm rights under California law.

One of the most frequent calls I get are from people who want to restore their fi***rm rights. The thing is, even though California allows the ability to reduce a prior felony conviction to a misdemeanor, which then would allow you to possess fi***rms, you are still prohibited under federal law because it is still recognized as a felony conviction.

The announcement from the federal government that they will be accepting applications to restore fi***rm rights under 18 USC section 925(c) is going to fix that problem.

I am keeping a close eye on this development to be ready to assist anyone interested in restoring their fi***rm rights. The government indicated they will be releasing and accepting applications 30 days from the initial announcement on August 17th.

A new avenue for federal fi***rm rights restoration is about to become available.

Under 18 U.S.C. § 925(c), certain individuals prohibited from possessing fi***rms under federal law may seek relief from their federal fi***rms disabilities. For decades, this avenue for relief has been effectively unavailable.

The U.S. Department of Justice has announced that applications for relief will become available 30 days after August 17, 2026.

This may provide an important new opportunity for eligible individuals seeking to restore their fi***rm rights under federal law.

Lieberman Law, APC will be assisting clients with applications for relief under 18 U.S.C. § 925(c) once the application process opens.

A California CCW denial is not always the end of the process.

Depending on the reason for the denial, California law may provide a legal avenue to challenge the issuing agency’s decision through the courts.

Not every denial should be appealed, and every case is different. The key is understanding why your application was denied and whether there is a legal basis to seek judicial review.

Receiving a CCW denial can be discouraging, but it does not always mean your case is over.

I’m grateful for clients who take the time to share their experience and trust me to represent them through the legal process.

In this case, my client was denied a California CCW license. After filing a petition challenging the denial, the court reversed the decision and ordered the issuing agency to proceed with issuing the license.

Every case is different, and not every denial can or should be challenged. But if your application has been denied, it’s important to understand your legal rights and whether judicial review may be available.

Not every California CCW application is approved.

California law identifies several reasons an issuing agency may deny a CCW application. In this video, I discuss two of the most common:

• Whether the applicant is determined to be a danger to themselves or others.
• Whether the applicant knowingly provides false or incomplete information during the application process.

Understanding these issues before you apply can help you avoid common mistakes and better prepare your application.
