Florida employers may have new options when it comes to non-compete agreements.

Florida’s new CHOICE Act strengthens employer protections, especially for higher-paid employees and independent contractors.

But stronger protections don’t mean automatic protections.

To take advantage of the law, employers must follow specific technical requirements.

❌ MYTH: “Business planning becomes important once the company grows.”
✅ FACT: Early decisions often create the structure businesses operate and build upon for years.

Formation is frequently treated as simple paperwork - something to complete quickly so operations can begin. But many challenges businesses encounter later trace back to decisions made at the beginning.

Entity choice, ownership structure, governance, partnership terms, taxation and operational planning are often viewed as separate conversations. In practice, they tend to affect one another over time.

👉 Business planning is not only about starting. It is about creating a structure that supports future decisions.

⚠️ A plan that is not understood is difficult to execute.

People appointed in a plan may not know they’ve been chosen. Beneficiaries may not understand what they are receiving, how distributions work, or how different parts of the plan fit together.

When families do not communicate, even thoughtful planning can become fragmented. Expectations differ, decisions become disconnected, and the plan may not function the way it was intended.

Transparency does not mean sharing every detail. It means making sure the people involved understand their roles, responsibilities, and how the broader plan works together.
