Can pre-existing conditions hurt your case in Florida? Not the way most people think.

Florida follows what's called the eggshell plaintiff rule — the person who caused your accident has to take you as they are, pre-existing conditions included. If a crash worsens a bad back, an old injury, or a condition you were already managing, you can still be compensated for that aggravation, even if a completely healthy person would have walked away with less damage.

Where it gets tricky is proving the difference between what existed before and what got worse because of the accident. Insurance companies often try to argue your injuries were already there, not caused by the crash — which is why medical records, documentation, and being upfront about your history matter so much.

3 things that can destroy your case (that no one tells you) ⚠️
Posting on social media. Even a single photo — a workout, a trip, a smile — can be used by insurance companies to argue your injuries aren't as serious as you claim. Even private accounts aren't fully safe, and deleting posts later can look like destroying evidence.

Gaps in medical treatment. Skipping appointments or waiting too long to seek care creates room for the insurance company to argue your injuries weren't serious, or weren't caused by the accident at all.

Talking about your case with anyone but your lawyer. Casual conversations, even in person, can come back around — the only truly protected conversation is the one you have with your attorney. In this video, Attorney Jason breaks down these hidden case-killers and how to protect your claim from day one.

Instead of saying "I'm sorry" after an accident, say nothing about fault at all. Apologizing, even out of habit, can be used by insurance companies to suggest you're admitting responsibility — regardless of what actually happened.

Instead of saying "I'm fine" or "I don't need medical help," say that you'll be checked out to be sure. Some injuries don't show symptoms right away, and telling anyone you're okay on the scene can be used later to argue your injuries aren't related to the accident.

Instead of guessing what happened — "I didn't see you," "I think they were speeding" — stick to the facts you're certain of and let the investigation, your attorney, and the evidence determine fault. In this video, Attorney Jason breaks down more of what to say (and what not to say) after an accident, so you're protected from day one.
