Fifty years ago, in People v. DeBour, the New York Court of Appeals announced a new standard to evaluate police conduct involving street encounters. Since then, this four-tiered approach has been both lauded and criticized. Has DeBour succeeded, or are there better methods of addressing this issue?

Hon. John M. Leventhal (Ret) argued before the New York State Court of Appeals with Imran Ansari and Giovanni Orlando Conti.

Leventhal argued that judges are entitled to be free from discrimination on the basis of an age-based criterian. Pursuant to law, they have a free standing, standalone civil right not to be discriminated against because of age.

ABK Law Partner Hon. Barry Kamins (Ret) is speaking about ‘Search and Seizure Updates’ at the Kings County Criminal Bar Association (KCCBA) CLE.

BROOKLYN HEIGHTS - THE KINGS COUNTY Criminal Bar Association, a community legal organization dedicated to the improvement of the criminal justice system in Brooklyn, will be having its next CLE covering search and seizure updates, presented by Hon. Barry Kamins.
The event will take place on May 14, at 123 Remsen St.

In the context of law, search and seizure refers to the government’s actions of examining a person’s property or belongings and taking possession of items found during that examination, which are protected by the Fourth Amendment against unreasonable actions. A “search” occurs when law enforcement examines a person’s property or belongings to gather evidence. A “seizure”
happens when the government takes possession of an item or property.

“The topic of search and seizure is always evolving” Kamins said, who is also the author of several books on the topic.
