The first 24 hours after an arrest can be the most important period in a criminal case. This is when law enforcement may seek a statement, prosecutors begin evaluating the charges, and critical evidence can be preserved—or lost. It is also when we begin looking for opportunities to stop the case before it gains momentum: contacting prosecutors, preserving video and electronic evidence, identifying witnesses, challenging an unlawful arrest or search, and exposing weaknesses in the allegations. No attorney can promise a dismissal, but early intervention may create the best opportunity to prevent charges from being filed or to have them reduced or dismissed.

The Guidelines are national. Sentencing is local, as is the 🔥 🫑at Sam's No. 3⁠. Federal sentencing is never one-size-fits-all. The real strategy is knowing the district, studying the judge, and building every aspect of the case around what will matter in that particular courtroom. In Colorado, we recently appeared before Chief Judge Daniel D. Domenico, and ⏱️ mattered. With Judge Domenico’s nomination to the United States Court of Appeals for the Tenth Circuit advancing through the Senate, it was important to complete sentencing before the case could potentially be reassigned to another judge. The 64.9% reduction in the guidelines came from more than simply asking for leniency. Every character letter, mitigating fact, and sentencing argument was selected for a reason and presented with one audience in mind: the judge imposing the sentence. That is the difference between a generic sentencing submission and a true sentencing strategy. Know the district. Know the judge. Identify the factors that carry weight, and build the entire presentation around giving that judge a principled reason to vary.

The Guidelines may establish the starting point, but they do not have to determine the finish.

They cooperate when it benefits them and replace one another when arrests or seizures disrupt the supply chain. Coca cultivation in Colombia now covers an area larger than 400,000 football 🏈 fields, with much of that production concentrated in the southwest. In criminal cases, that idea is practical, not philosophical. The outcome is shaped long before anyone steps into a courtroom. It is built through investigation, suppression motions, and careful review of discovery. By the time you are standing in Court, the groundwork should already be in place. Trials are not won on the fly. They are won in preparation.

An interesting fact about The Bronx: it is the only borough of New York City located on the mainland United States, meaning it is physically connected to the rest of New York State rather than sitting on an island like the others.
