Employment Laws Await Governor’s Signature.
Legislature Approves Two Bills Governing Employment Recruiting and Separation.

The New York Legislature has ratified two employment law measures, one regarding a worker’s right to severance and the other addressing so-called “ghost job” postings. Both bill await signature by Governor Kathy Hochul.
The Job Advertisement Disclosure Law

It has become somewhat common practice for many employers to advertise general postings, often unrelated to any actual current needs. New York Times Faces Allegations of Discrimination against White Males.
Lawsuit Claims Racial and Gender-Based Discrimination
In a lawsuit filed by the Equal Employment Opportunity Commission on behalf of an employee of the publication, the New York Times has been hit with a wrongful discrimination lawsuit alleging that it unfairly treated white males seeking promotions within the company. The lawsuit specifically contends that the New York Times “chose not to promote a well-qualified white male employee because of his race and/or sex.” Officials at the paper deny the allegations. City Seeks to Shut Down Food Delivery App.
NYC Alleges Serious Wage and Hour Violations by Motoclick.

The New York City Department of Consumer and Worker Protection has filed a request in federal court to ban a food delivery app from conducting business within the city, citing extensive violations of state and federal wage and hour laws. The city sought a preliminary injunction against Motoclick (a business of Patio Delivery, Inc.), a company that competes directly with such well-known app-based enterprises as DoorDash, UberEats and Grubhub.

Lawmakers Respond to Growing Reports of Workplace Discrimination based on Caste.

New York state lawmakers are considering a bill that would make “caste” a protected class under state laws governing discrimination in the workplace. Caste is a societal system that labels individuals based primarily on heredity or descent, commonly assigning them to categories such as “high,” “low,” or “untouchable.” Most commonly associated with India, the caste system is in fact deeply entrenched in cultures across South Asia, including Pakistan, Sri Lanka, Nepal, Bangladesh and Bhutan. It’s found to a lesser extent in Japan and on the African continent.

At Stephen Hans & Associates, we have successfully advised and represented many New York City employers many years, helping them meet employment law requirements and protecting their rights in employment litigation, including claims involving allegations of workplace retaliation.
