When you’re building something, when you’re doing the damn thing, when you’re proving to yourself you are enough, there is no such thing as Monday motivation.

There’s motivation Every. Single. Day.

Keep going. The only person stopping you is yourself.

It’s easy to blame the nurse. Or the CNA.

And yes, there are bad employees in every industry, and individual accountability matters.

But after handling nursing home cases, I think we need to talk a lot more about what’s happening above the people providing the hands-on care.

When a CNA is responsible for too many residents, something has to give. Call lights take longer. Residents wait for help to use the bathroom. Repositioning gets delayed. Showers get missed. Staff rush from one resident to the next.

Meanwhile, the people making decisions about staffing, wages, and resources may be sitting in a corporate office hundreds of miles away from the residents and employees living with the consequences of those decisions.

Most nurses and CNAs I encounter care about their residents. Many are trying to do an incredibly difficult job with limited time and resources.

Pay them better. Give them enough coworkers. Give them the resources to actually provide the care residents deserve.

If that meant I had fewer nursing home neglect cases someday, I’d be thrilled.

Because the goal isn’t more lawsuits.

The goal is fewer people getting hurt.

Our parents and grandparents deserve to be safe. And someday, we will too.

Can you legally put a “granny cam” in your loved one’s room?

In Wisconsin, the answer depends on where they live.

Residents in assisted living have clearer rights when it comes to personally controlled cameras and electronic monitoring. Skilled nursing facilities are different, and families shouldn’t assume the same rules apply.

And there are other things to think about too: Who gets to consent? What if there’s a roommate? Is the camera recording audio? What happens during bathing or other private care?

Cameras can give families peace of mind and, in some situations, provide important information about what is happening when they aren’t there.

But before you hit record, know the rules. Each state’s rules are different. What is often always a consideration though are privacy rights.

Audio recordings create additional layers of legal issues too. Wisconsin is a one-party consent state. But, that does not mean that you can record every conversation in your loved one’s room.

Deposition 101.

Depositions sound intimidating. But they don’t have to be.

A deposition is simply sworn testimony given before trial. The other lawyer gets to ask you questions about what happened, what you remember, your injuries, and other issues relevant to the case.

And yes—they’re paying attention to more than your answers. They’re evaluating your credibility, locking down your testimony, and getting an idea of how you may come across to a jury.

But here’s what I tell my clients: you are not there to “win” the deposition.

Listen to the question. Answer what was asked. Tell the truth. Don’t guess.

And if you genuinely don’t know or don’t remember? Say that.

You don’t need to have an answer for everything to be a credible witness. In fact, sometimes trying to have an answer for everything does the exact opposite.

Your job isn’t to outsmart the other lawyer.

Your job is to tell the truth.

When someone you love dies after being injured in a nursing home, your first thought probably isn’t about evidence or records. You’re grieving.

But if something about what happened doesn’t sit right with you, don’t ignore that feeling.

Request your loved one’s medical records. Write down exactly what you were told, by whom, and when—especially if you received different explanations. And remember: the cause of death doesn’t always tell you the whole story.

A fall can lead to a fracture. A pressure wound can lead to an infection. An infection can lead to sepsis. What happened in the days and weeks before someone died can matter just as much as what appears on the death certificate.

Sometimes there is a reasonable explanation for what happened. Sometimes there isn’t.

The question I always come back to is simple:

How did we get here?

People often assume families hire a nursing home lawyer because they’re chasing a paycheck.

In my experience, that’s rarely how the conversation goes.

It usually starts with questions.

What happened? Could this have been prevented?

Families want someone to look at the medical records, timelines, and documentation…and tell them the truth.

They want accountability.

Because accountability isn’t just about a lawsuit. It’s about understanding what happened to someone they trusted others to protect.

If you’ve ever had to place a loved one in a nursing home, you know the trust that decision requires. And when that trust is broken, the search for answers matters more than money.

If you discover unexplained bruising on a loved one in a nursing home, don’t wait for the facility to tell you what happened.

Here are 3 important steps to take:

1️⃣ Seek medical attention. Have your loved one evaluated as soon as possible to ensure that their health and wellbeing is addressed first.

2️⃣ Take photos. Photograph the bruise from multiple angles and continue documenting it over the next several days as it changes. Good documentation can be incredibly important.

3️⃣ If you suspect abuse or neglect, report it immediately. If your loved one is in immediate danger, call 911. Report your concerns to local law enforcement, the nursing home administrator and director of nursing, and your state’s licensing agency. You may also wish to contact your local Long-Term Care Ombudsman.

A bruise doesn’t automatically mean abuse or neglect occurred. But it should never be ignored. Prompt medical care, thorough documentation, and timely reporting can help protect your loved one and potentially other residents as well.
