Legislative News: Divorce by Affidavit was signed into law by Governor Evers. Senate Bill 189 will now be 2025 Wisconsin Act 40. This amends provisions of Chapter 767 and creates Wis. Stat. § 767.235(1)(b).

The legislation was a Family Law Section of the State Bar of Wisconsin initiative. It is a reminder of the work the Family Law Section does to advance family law issues in the State legislature. The law is effective now and will streamline the finalization of divorce when certain conditions are present by allowing you to finalize your divorce without a personal appearance in court or on Zoom.

Divorce by Affidavit will not be for everyone. For instance, in order to use the new Divorce by Affidavit option, both parties need to be represented by counsel or have worked with a lawyer mediator who is registered on the case and drafted and filed the signed stipulation. This is a reminder that every divorce is different. Divorce by Affidavit adds one more option for family law attorneys so that they can properly inform their clients.

Thank you to the bill sponsors in the Legislature for listening to and supporting the Family Law Section Board’s efforts, the Family Law Section Board for working on the legislation and sending members of the board to testify in support of the legislation, and Lynne Davis the Section’s Government Relations Lobbyist who worked diligently over several years to get this legislation passed.

The January issue of the Wisconsin Journal of Family Law will provide a more detailed look at this new law to assist family law practitioners to better understand the new law so that clients can be properly informed about when to use this new process.
