Contrary to what many people think, naming a man on a child’s birth certificate doesn’t legally establish him as the child’s father. If the parents aren’t married at the time of birth, the mother is granted full legal custody and must establish paternity by a court order in order to file for child support. If the parents do not agree as to who the child’s father is, paternity may be established by a DNA test.

Thankfully, the team at Kowalski, Wilson & Vang, LLC, has extensive experience helping Wisconsin families navigate difficult situations like these. Reach out to us today to learn more and set up a consultation.

In matters of distributing military benefits in a divorce, there’s no one-size-fits-all solution. For instance, under the 20/20 rule, a spouse who has been married to a service member for 20 years is entitled to lifetime benefits if the marriage overlaps the member’s years of service. But even spouses who have been married for less time can receive benefits in certain circumstances.

Whether you are a service member or the spouse of a service member, it’s critical to consult with a divorce lawyer familiar with military divorces. The team at Kowalski, Wilson & Vang, LLC, has experience helping clients navigate the unique complexities of military divorces. Contact us today to set up a consultation.

If you have a “stay away” order of protection or have been granted exclusive occupancy of your home by the court, you may change the locks. Otherwise, changing the locks is illegal, even if your spouse’s name is not on the deed or lease.

When it comes to changing the locks, it’s wise to consult with an experienced divorce attorney. At Kowalski, Wilson & Vang, LLC, we’re committed to helping our clients navigate the challenges of divorce. Get in touch with us today to set up a consultation.

Parents must be able to prepare kids to enter the world as adults one day. And there are two parts to that equation: providing for physical needs and making life decisions. In child custody battles, physical placement deals with where kids will live and which parent will be responsible for managing their daily needs, such as food, shelter, transportation, and so on. Legal custody, on the other hand, deals with decision-making authority related to education, religious instruction, healthcare, and the like. If you need legal support in a custody battle, contact the attorneys at Kowalski, Wilson & Vang, LLC today.

Most people get married because they fall in love and want to spend the rest of their lives with that special someone. Nevertheless, it’s important to understand that marriage is also a legal contract and even a business arrangement in some cases. If you enter a marriage with significant assets, it’s wise to protect them with a prenuptial agreement, the same way you might defend personal assets before starting a business.

What are your thoughts on protecting individual assets before getting married? Share your opinions in the comments. And if you want to learn more about prenuptial and postnuptial agreements, contact us at Kowalski, Wilson & Vang, LLC today.

Wisconsin is a marital property state, which means all assets are divided 50/50 or as equally as possible in a divorce. This includes personal property like a home, automobiles, and bank accounts. What about your business? With few exceptions, what one of you owns belongs to both of you, including businesses. A pre-nuptial agreement could cover a business, but otherwise, you’ll have to negotiate or let the courts decide how to split assets. The attorneys at Kowalski, Wilson & Vang, LLC are here to help business owners negotiate fair outcomes for the division of assets during divorce. Contact us to learn more.
