“It was just an accounting error.”

That's the explanation.

But what do the records show?

When money disappears from a business account, the investigation shouldn't stop at one transaction.

Look at the timing.

Who authorized the transfer?

Where did the funds go?

Was the transaction documented?

Did it happen before or after the partners began disagreeing?

An accounting mistake and a potential breach of fiduciary duty are very different legal issues.

The evidence helps determine which explanation holds up.

“Your father doesn't care about you.”

Imagine being a child hearing that from someone you love.

Now compare it with:

“Your dad and I have disagreements, but we both care about you.”

One statement puts the child in the middle of an adult conflict.

The other offers reassurance without requiring the child to choose sides.

In custody proceedings, evidence of how parents communicate and manage conflict may be relevant to the child's best interests.

Your relationship ended.

Your child's need for emotional security didn't.

You might have evidence.

You might have witnesses.

You might even have a legitimate legal claim.

But if you wait too long, you could lose the opportunity to pursue it.

California has different filing deadlines depending on the type of case, and exceptions or special rules may apply.

That's why timing matters just as much as preparation.

If you believe your legal rights have been violated, don't assume you have unlimited time to act.

When trustees fail to fulfill their fiduciary duties, financial losses to a trust may lead to legal disputes. California probate courts examine trustee conduct, financial records, and alleged breaches of duty when evaluating surcharge claims.

Courts may require trustees to compensate a trust for losses resulting from misconduct or improper administration. Understanding how these claims are evaluated helps clarify the responsibilities trustees have when managing trust assets.

“Technically, I'm not breaking the rules.”

That doesn't always mean you're legally in the clear.

In California family and civil disputes, complying with one requirement doesn't automatically mean your overall conduct is lawful.

The exact language of a court order, your legal obligations, and the surrounding circumstances can all matter.

A clever workaround might seem harmless until it creates a new dispute or raises questions about whether you've complied with your obligations.

Before testing a legal loophole, make sure you understand the consequences.

Document your reasoning, review the applicable rules, and speak with an attorney before acting—not after.

Three attempts to suspend our client. Three unsuccessful applications.

In a contested Santa Clara County probate matter, the opposing party sought to remove our client from their roles as trustee and estate executor, alleging financial mismanagement.

They also filed three separate ex parte applications seeking to suspend our client's authority while litigation was ongoing.

Attorney David Chan challenged each attempt through rapid responses, supporting documentation, and declarations—sometimes preparing same-day filings and delivering courtesy copies directly to the court.

Chan also challenged the court's subject matter jurisdiction over the requested executor removal.

The opposing party ultimately withdrew its request, discontinued the case, and the scheduled trial was vacated.

The takeaway? Strong documentation, preparation, and timely legal responses can make a significant difference in contested probate litigation.

She had an affair with her employer’s husband.

Then she got fired—and her employer refused to pay her final month’s wages.

But does misconduct automatically mean an employee loses the right to be paid?

Under California employment law, wages earned for work actually performed generally remain owed, even when an employer has a legitimate reason to terminate the employee.

A breach of a professional conduct clause may justify termination, but it doesn't automatically erase an obligation to pay earned wages.

The affair and the unpaid wages are two separate issues.

What someone did wrong doesn't automatically determine what they're legally owed.

Contractual recoupment disputes can arise when one party seeks to reduce a payment obligation because of financial losses connected to the same transaction. These disagreements often involve contract performance, disputed payments, and competing financial claims.

California courts may examine contract terms, financial records, and the relationship between the alleged losses and the original payment obligation when evaluating recoupment disputes.

Can your ex stop you from moving after separation?

Moving yourself and relocating with the children are two very different legal questions.

When children are involved, an existing custody order, the proposed move, distance, parenting arrangement, and the child’s best interests can all become relevant.

Don’t treat a move-away case like a simple change of address.

The custody implications can be much bigger.

Want the real S-tier custody schedule?

It depends on your kids.

Not TikTok.

Not what worked for your friend.

Not what sounds the most equal.

Your children’s ages, school schedules, routines, relationships with each parent, travel between homes, and family circumstances can all affect what arrangement makes sense.

A parenting plan should fit the children who actually have to live it.
