🚨 DHS Finalizes Rule Ending Automatic EAD Extensions

DHS has finalized the rule that ended automatic EAD extensions for many renewal applicants. The change has applied to covered renewal filings made on or after October 30, 2025.

For many applicants, a pending EAD renewal alone does not permit continued employment after the current card expires.

This may affect, among others:

β€’ Pending asylum applicants (C08)
β€’ Adjustment of status applicants (C09)
β€’ Eligible H-4 spouses (C26)

Important exceptions may apply. Certain timely renewals filed before October 30, 2025 remain covered under prior rules, and separate provisions may apply to TPS-related documentation and some other categories.

Check your EAD expiration date, filing date, and eligibility category early.

A Mandamus lawsuit may be an option when an immigration case has faced an unreasonable delay.

Filing a complaint begins a federal court process, but it does not guarantee approval. The government may respond, request dismissal, or take action on the underlying case. Any action taken may result in an approval, denial, request for evidence, or another decision.

Every case requires an individual legal assessment.

Is your immigration case still pending?

A long delay alone does not automatically mean that filing a mandamus action is appropriate. Before considering this option, the case type and filing date, published processing time, current case status, prior inquiries, and any pending RFE, biometrics appointment, interview, or response should be reviewed.

A mandamus action may seek to require the agency to take action, but it does not guarantee approval or any particular outcome.

A new precedential decision from the Board of Immigration Appeals highlights how important consistency and credibility can be in immigration bond proceedings.

In Matter of Y-M-B-, the BIA treated the deliberate omission of material information in an asylum applicationβ€”and the denial of that asylum claimβ€”as significant negative factors when assessing flight risk. In that case, a previously granted $12,000 bond was revoked.

This does not mean that every denied asylum case will result in detention without bond. Bond decisions remain fact-specific. However, material inconsistencies, identity concerns, and credibility issues may affect the outcome.

If you or a loved one is in ICE custody or facing a bond hearing, timely legal guidance can make a difference.

The October 2026 Visa Bulletin includes important updates for certain family-based and employment-based immigrant visa categories.

If you have a pending F2A, F2B, EB-2, EB-3, or Other Workers case, your priority date and country of chargeability may affect your next step.

For applicants seeking adjustment of status in the United States, USCIS determines which chart may be used each month.

When an immigration case has been pending for a long time, the waiting can feel overwhelming. But a long delay alone does not automatically mean that a Mandamus lawsuit is appropriate.

Whether a case may warrant legal review depends on the full picture: the case timeline, the agency’s published processing times, any requests for evidence, the actions already taken, and whether the delay is causing real harm.

A Mandamus action may ask a court to require a federal agency to take action on a delayed case. It does not guarantee approval of an application.

If your immigration case has been pending without meaningful progress, a case-specific review can help you understand your options.

A long delay in an immigration case can be frustrating, but it does not automatically mean that a mandamus action is the right next step.

A mandamus lawsuit may be considered when an agency has delayed action on a case beyond a reasonable time. However, the timeline alone is not enough. The history of the case, the reason for the delay, and the available legal options should all be reviewed carefully.

Most importantly, a mandamus action asks the government to actβ€”it does not guarantee that an application will be approved.

If your immigration case has been pending for an extended period, NGA Law APC can help you understand whether a legal review may be appropriate.

Was your asylum case referred to Immigration Court?

A referral does not necessarily mean that your asylum claim has been finally denied. Your case may proceed before an immigration judge, often beginning with a Master Calendar Hearing and, if necessary, an Individual Hearing where evidence and testimony may be reviewed.

Check your hearing dates regularly, do not miss any court appearance, keep your address updated with the Immigration Court, and organize your supporting documents.

If your case has been referred to Immigration Court, contact NGA Law APC for a case-specific legal evaluation.
