When does poor insurance handling cross the line into bad faith?

A delay, denial, or low offer is not automatically bad faith. Generally, the conduct must be unreasonable or without proper cause.

Depending on the policy, circumstances, and state law, potential warning signs may include:

• Failing to conduct a reasonable investigation
• Unreasonably delaying a decision or payment
• Withholding benefits without a reasonable basis
• Failing to clearly explain a denial
• Misrepresenting policy terms or available benefits

Bad-faith rights often involve the relationship between an insurer and its own policyholder. Rules for third-party claimants may be different.

The lien most people never expect may come from their own health plan.

When a health plan pays accident-related medical expenses, it may seek reimbursement if the injured person later receives compensation from another source.

But reimbursement rights are not identical. Medicare, Medicaid, employer-sponsored plans, and private health coverage may follow different rules. The plan documents and the charges connected to the accident must be reviewed carefully.

Depending on the circumstances, it may be possible to dispute unrelated charges, correct the claimed amount, or pursue an available reduction—but reductions are never guaranteed.

No wet-floor sign? That detail could matter—but it does not automatically make the store responsible.

Businesses generally have a duty to take reasonable steps to keep their property safe. If a store knew, or reasonably should have known, about a spill, it may need to clean it up or provide an adequate warning.

Evidence such as surveillance footage, cleaning logs, incident reports, photographs, and witness statements may help show how long the hazard existed and how the store responded.

Because footage may be overwritten and records can become harder to obtain, preserving evidence early can be important.

Your case is in “discovery.” Now what does that actually mean?

Discovery is the stage of a lawsuit when each side formally requests and exchanges relevant information and evidence.

It may involve:

• Written questions
• Requests for documents
• Medical records
• Depositions
• Information from witnesses or other parties

What you personally need to do depends on your case. Your legal team should explain each request, prepare you for any necessary participation, and keep you informed throughout the process.

You shouldn’t need a law degree to understand your own case.
