his is Ask Brad Kane Law. And under the heading of, Be Careful What You Ask For, a woman in Canada challenged her dismissal, saying that there was no grounds to fire her. Well, it turned out the employer had tracking software that showed that she had not worked 50 hours that she claimed, and she said she was working on paper, but they proved that the printer didn’t print anything or very little, and so she ends up having to pay them $2,800. So before you go suing your employer, you might wanna make sure that you have actually worked the hours you claim, or it can be a major problem.
The flip side is we all have to worry about what restrictions there should be on employers putting tracking software on our own personal devices, especially if we’re doing work from home. This is Ask Brad Kane Law.

This is Ask Brad Kane Law. Employee trains for two weeks on the job, sends in his availability for his first week of “work.” One day they want him to work, he's not available, so he doesn't get on the schedule. He says, Hey! Well what about my pay for the training time? They said, we don't have to pay you for that because you didn't work out as an employee. No, that's wrong. You have to pay people the amount you agreed to pay them, and it has to be at least a minimum wage for all hours worked, including the training.

And if they don't pay that, not only do you get that amount of money plus liquidated damages equal to at least the amount of minimum wage they didn't pay, pay sub penalties and waiting time penalties. So there's a host of reasons why people should pay and then figure out whatever questions they have later. This is Ask Brad Kane Law.

This is Ask Brad Kane Law. I’m going to give you some really good advice to share with your teenage sons and daughters. The FBI has put out a bulletin about a dramatic increase in what they call sextortion, which is people posing as their peers or someone they might be interested in, getting them to send n**e photos online to them and then blackmailing them, that they’re going to spread them everywhere.

And this has led to a number of suicides. So the answer is don’t share naked photos. Don’t share photos that you wouldn’t do it unless you’ve seen the person in person you’ve met with them. Maybe even not then, but don’t just do it with strangers. This is Ask Brad Kane Law.

Are you a T-Mobile customer or do you want money? Well, if you’re a T-Mobile customer in 2021, then you are eligible to participate in a $350,000,000 class action settlement for a data breach where T-Mobile originally claimed only less than 800,000 people’s information was stolen, it turned out to be $76 billion. So what you need to do is go to the T-Mobile Data Breach Settlement website, fill out your information.
If your a California resident, you’re entitled to $100, other people may only get $25. This is Ask Brad Kane Law.

This is Ask Brad Kane Law. The Disney owned production company that produced Criminal Minds has settled a lawsuit alleging that the director of photography subjected male crew members to unwanted touching, caressing, unwanted comments and threats for $3 million with an M. The reason why they did this is apparently the evidence was pretty strong and it went on for years because the producers let him retaliate against the people who were complaining, and that is why they are responsible for what happened.
Now, if you are suffering from unwanted touching, caressing, comments, retaliation, it is a good time to talk to a lawyer to help you craft your complaint and make sure that it’s got all the right language in it so that you have a record, and then you can perhaps talk to a lawyer to figure out what the best thing to do is in your economic circumstance, because you may not be able to lose that job. That’s how they keep people quiet.

This is Ask Brad Kane Law. An employee is having Cal Savers deductions of 5% coming out of their biweekly paycheck, but the money that comes out of their paycheck doesn’t make it into their statement. What can they do? Well, #1. Write a polite email, take screenshots and show them and ask where the money went, because you can see the deduction on your pay stub, so there should be a matching amount in your retirement plan.

If it’s not there and they don’t correct it quickly, I would do two things. I would start looking for another job because it means they having financial difficulties, or at least implies strongly that they have financial difficulties. And I’d filed a complaint with the Labor Commissioner because they are stealing your money if they’re not accounting for it. This is Ask Brad Kane Law.

This is Ask Brad Kane Law. Today’s question comes from an employee, or I guess former employee who filed a wage claim with the labor commissioner. The former employer offered half of the money that he feels is owed. He has a personal emergency, wants you get paid faster, and the Department of Labor says that it’s gonna take at least a year for the merits hearing. What can he do? Well, he can hire a lawyer, as an open wage claim.
He can have the lawyer send a demand letter. Attorney fees are coverable if wages are owed, and they can file a lawsuit and move it along probably a lot faster. This is Ask brad Kane Law.

This is Ask Brad Kane Law. A woman is recorded peeing in the bathroom with both her face and crotch visible. Her boyfriend is outraged and wants to punch the guy. They know who it is, in the face and he wants to know if he can get sued. Of course you can get sued, especially days later you punch someone in the face because they did something you don’t like, that is not okay. What can you do and what should you do? You take the video showing who it is and you give it to the police.

This is Ask Brad Kane Law. Landlord says that a tenant has ignored 20 notices to clean up their dog’s p**p. Can they fine them because it’s a violation of the municipal code section? I think it’s 5349, and the answer to that question is no. You are not law enforcement. You are not the government. What you can do is you can evict them for nuisance or try to evict them for nuisance, or you can videotape it and then hand it to the police and see if they’ll cite them. This Ask Brad Kane Law.

Employee gets a job offer, or at least it’s being drafted. They have an auto accident and the employer decides, uh, to pull the offer. Do they have any recourse? Maybe if they were injured or disabled in the accident, the employer knew about it and therefore decided, Hey, I don’t want to hire this person because they’re temporarily or permanently disabled. Yeah, you might have a claim if you could show that otherwise you can be terminated or not hired for any reason or no reason except a prohibited reason.

And the fact that you might be a bad driver is not a protected reason. This is Ask Brad Kane Law.

This is as Brad Kane Law. An employee is getting d_ck pics at work. What can they do? #1. I would say it’s a very sensitive issue. Talk to an employer before you respond and talk to the HR, the presence. Somebody put it in writing, perhaps forwarding copies of the pictures. And so they’re responsible if they don’t take action to protect you immediately. #2. You can have a lawyer send a demand letter if they don’t take action and then file a lawsuit because nobody should be subject to that kind of unwanted and unwelcome conduct.
