"A hypoxic ischemic encephalopathy diagnosis turns a family’s world upside down overnight. Parents want answers immediately, and it feels natural to assume that proof of the injury is proof that someone did something wrong. Your baby has HIE but does that prove medical negligence? For most families, the honest answer is no, not on its own."

"A baby’s HIE brain injury can change a family’s life in ways they never expected. For many families, the questions begin immediately. What happened? Why did this happen? Could something have been done differently?

One thing families quickly learn is that the legal process requires patience. A birth injury matter is not built overnight. Before reaching mediation or trial, attorneys spend significant time reviewing medical records, working with medical experts, and developing the issues that will shape the case."

This preparation is one reason the journey after a baby’s HIE brain injury can take time. The goal is not to rush through the process...

"If your family has filed an HIE birth injury claim and mediation is approaching, feeling anxious is normal. You may not know what to expect, and that uncertainty can be unsettling. The good news is your lawyers will be there with you the entire time. Part of their job is preparing you beforehand, so you understand the process and are not left to face difficult conversations alone. This applies to mediations where both sides are genuinely working toward resolution, meaning the people with authority to settle are present or available to approve an agreement."

Two of the hardest conversations families face during their baby’s HIE mediation often catch parents off guard, which is why...

"My baby has severe HIE what should I as about the MRI? That question came from a viewer after one of my recent videos, and it’s one of the most important questions a family can ask. When a baby is diagnosed with severe HIE and undergoes cooling, the brain MRI becomes one of the most important pieces of information doctors use to understand what happened and what comes next. But MRI reports are full of technical language, and it can be hard to know what to ask."

In a recent video, I explained that an HIE diagnosis does not automatically mean a baby will develop cerebral palsy. Afterward, I got a good follow up question. Someone wanted to know how often I actually see babies diagnosed with cerebral palsy after an HIE diagnosis. It is a fair question, and one I will restate here…Why do I see so many babies with cerebral palsy after an HIE diagnosis?

If you just heard the words hypoxic ischemic encephalopathy attached to your baby’s name, your mind is probably racing toward one question above all others. Does an HIE diagnosis mean my baby will have cerebral palsy?

It is one of the first fears that surfaces, and it makes complete sense. You want to know what comes next, and you want an answer now. The honest answer is no, not automatically. HIE and cerebral palsy are related, but they are not the same diagnosis.

"When contractions come too close together during labor and a baby has HIE, attorneys look closely at nursing documentation, Pitocin dosing records, and the fetal heart tracing timeline. Was the Pitocin reduced or stopped when tachysystole appeared? Was the care team responding to what the monitor was showing them? These questions often sit at the center of birth injury litigation."

"Many families who pursue birth injury cases involving hypoxic-ischemic encephalopathy eventually face a crossroads…go to trial or settle. After a recent video on jury trials, several families reached out with questions about mediation and what that process actually looks like."

This is precisely why some parents cannot tell their baby’s HIE story years after their case resolves. The terms of the settlement can...

"One of the most painful moments for a family navigating a birth injury case is realizing that the medical records tell a different story than what they witnessed in that delivery room. It happens more than most people would expect. A baby can sustain a serious hypoxic-ischemic encephalopathy diagnosis, and yet the chart reads as if everything went according to plan."

When a situation like this happens and a baby suffers HIE injury but the records say everything was fine, families are left questioning...

"A parent recently left this question as a comment on one of my videos about HIE brain injuries at birth. So many families are navigating this situation with no roadmap, and that is why I want to address it directly. How do I find the right help after my baby’s HIE diagnosis? It is a question more families should be asking from the start."
