As of August 30, FMSHRC has lost its quorum. With Commissioners Jordan's and Baker's terms expired, Chair Rajkovich is the only sitting Commissioner, and the Commission can't take substantive action until at least two more are nominated and confirmed. No nominations have been announced yet.

What this means for mine operators:
🔹 Petitions for Discretionary Review can't be acted on. Appeals can still go directly to a U.S. Court of Appeals, but the process is more complicated.
🔹 Motions to reopen filed after August 21 are on hold. If MSHA opposes, penalties may stay delinquent, go to collections, and accrue interest while you wait.
🔹 MSHA enforcement hasn't stopped. Inspections, citations, and ALJ proceedings continue, and contest deadlines still apply.

In a published opinion, the Seventh Circuit sided with our client Consumers Concrete against Central States Pension Fund, holding that credit for a prior partial withdrawal liability is applied at the end of MPPAA's four-step calculation, not at step two, as the Ninth and Eleventh Circuits have held.

Under the fund's approach, the 20-year payment cap can swallow the credit entirely, leaving employers paying twice for the same liability. Here, that meant up to $9.3 million in additional payments. Under the Seventh Circuit's ruling, it could be zero.

This is an issue of importance to many employers, and the Seventh Circuit's opinion is the first appellate decision to apply the credit to provide a dollar-for-dollar reduction in the employer’s subsequent withdrawal liability. Congrats to Mark Trapp on the win!

Rare Win Against OSHA ⚖️

Finley Farmers Grain & Elevator just beat a Willful fall-protection citation and recovered ~$78,000 in attorneys' fees from OSHA under the EAJA — a rarely-granted remedy.

The ALJ found OSHA's own 1996 guidance (the "Miles Memo") exempted the cooperative from fall protection requirements for railcars away from any structure, and that OSHA's continued litigation after its own witnesses undercut its case wasn't "substantially justified."
