Law360 quoted CMC Senior Counsel Scott Hecker in its analysis of the Department of Labor’s new front‑office leadership and the enforcement priorities beginning to take shape.

Here is an excerpt of the article:

Hecker cited the proposed independent contractor rule that the Wage and Hour Division put forward in February, and the proposed joint-employer rule that it unveiled on April 22, less than 48 hours after former Secretary Lori Chavez-DeRemer’s announced departure.

“To have people at the top of the department who understand and appreciate those issues, I think, could be valuable as those rulemakings move forward, since they are substantial and impact a lot of folks,” said Hecker, who worked at the DOL under multiple administrations until March 2020.

MSHA Confirms Indefinite Delay for Silica Rule ⛏️🛡️

MSHA confirmed through a published final rule in the Federal Register that the agency will not enforce the 2024 silica rule indefinitely. This was published just before the original deadline (April 8, 2026) for Metal/Nonmetal mines to comply with the 2024 rule. This announcement from the agency comes amidst the ongoing challenges to the rule in the 8th Circuit and recognizes the judicial stay on enforcement of the rule, that has been in place since April 11, 2025. MSHA will continue to enforce its existing standards for respirable crystalline silica (or quartz).
