If you own cryptocurrency, your estate plan has to answer three separate questions, and most standard wills don't. ๐Ÿช™

1. Access โ€” Can your family actually reach the crypto? Wallets, exchanges, seed phrases. If they can't find it, they can't inherit it.

2. Legal authority โ€” Even with access, only a court-appointed executor has the legal right to move estate crypto. Having the password isn't the same as having the authority.

3. Ownership โ€” Texas law decides who inherits. If you die without a will, the intestacy rules apply. Even if someone has your keys, that doesn't mean the law considers it theirs.

Here's the gist: When someone dies with a valid will, and there's no debt to sort through or estate to actively manage, Texas has a shortcut. A Muniment of Title lets you admit the will to probate WITHOUT anyone being appointed as executor or administrator.

The court just signs an order confirming the will is valid.

That order becomes your legal authority to:

If your loved one died with a valid will AND had no unpaid debts (mortgage excluded), you may not need a full probate. Just one court hearing. No executor appointed. No ongoing administration. The will itself becomes proof of title.

Save this if your family owns property with a will in place.
