On May 21, 2026, USCIS issued a memo changing how officers evaluate adjustment of status cases. Meeting the basic eligibility requirements is no longer enough. Officers are now directed to apply heightened scrutiny — meaning you need to actively justify why your case deserves approval.

🚨 USCIS just changed the rules on green cards, and if you're on a visa in the U.S. right now, this affects you.

Under a new policy memo, most people on temporary visas, students, workers, tourist visas will now need to return to their home country to apply for a green card instead of doing it from inside the U.S.

This is a significant shift from what has been standard practice for years.

Today, Texas Tribune published an in-depth investigation into the case of our client, Andrea Pedro-Francisco, a 23-year-old Guatemalan asylum seeker who has been detained by ICE in El Paso since February 5th, five days before her scheduled surgery to remove an ovarian cyst.
Eight OB-GYNs and an emergency physician who specializes in detainee care reviewed 200 pages of her medical records. All nine agreed: Andrea is at high risk for a medical emergency and urgently requires surgery. They also said her treatment in ICE detention amounts to medical malpractice.
ICE continues to deny her surgery.
Our Managing Attorney Ruby Powers has been clear: "What the ICE medical team is telling her simply doesn't match up with what doctors in the outside world say. This is barbaric treatment at best and deadly at worst."
Andrea's case has captured the attention of members of Congress, Amnesty International, faith leaders, and medical professionals across the country. And still she waits, in pain, far from her family, without the care she urgently needs.
Her next immigration court hearing is today, May 20th.
