When couples think about proving that their marriage is genuine, they often focus on wedding photos and the marriage certificate. However, for immigration purposes, the evidence must tell a much broader story.

USCIS wants to understand whether the couple entered the marriage with the genuine intention of building a life together. This may be demonstrated through shared finances, housing documents, insurance policies, travel records, communication history, affidavits from family and friends, and other evidence created throughout the relationship.

In immigration, every step must be taken with honesty, transparency, and respect for the law. A strong case is built on truthful information, credible evidence, and a genuine story.

In my latest article, I explain which types of evidence can help strengthen a marriage-based Green Card case, the circumstances that may lead to greater scrutiny, and what couples should know about the interview and the removal of conditions process.

EB-2 NIW approval rates are moving in a positive direction. But what do the latest numbers really mean?

According to the latest USCIS data, approximately 55% of EB-2 NIW decisions were approvals during the third quarter of fiscal year 2026, covering April through June. USCIS approved 3,835 petitions and denied 3,103 during this period.

This improvement is encouraging, but it should not be interpreted as evidence that the EB-2 NIW process has become easier or that every new applicant has a 55% chance of approval.

USCIS continues to examine whether the applicant’s proposed endeavor has substantial merit and national importance, whether the applicant is well positioned to advance it, and whether waiving the job offer and labor certification requirements would benefit the United States.

The latest numbers reinforce an important message: strong cases are built through strategy. Professional experience alone is not enough. The petition must clearly connect the applicant’s background, evidence, proposed work, and potential contribution to the United States.

Statistics can reveal trends, but they cannot determine the outcome of an individual case. That requires a careful evaluation of the applicant’s profile and a well-structured legal strategy.
