UPDATE ON PROPOSED CHANGE TO IMMIGRATION LAW
New proposal would still require applicants to depart the U.S. HOWEVER, the proposal would require the applicant to submit his unlawful presence waiver prior to departing. A decision on approval or denial of the waiver would be rendered here in the U.S. If the waiver is approved, it would be done so ā€œprovisionally.ā€ The applicant would then leave the U.S. for processing in the applicant’s home country. Since there is a ā€œprovisionalā€ approval of the waiver, the applicant’s stay abroad would be relatively short. The ā€œprovisionalā€ approval would then become official once the processing is done in the applicant’s home country.

Under current law, the unlawful presence waiver is submitted in the applicant’s home country. While the decision is pending, the applicant must remain in his home country. It can take several months and sometimes years to get a decision.

Under the new proposal if the applicant submits his waiver and is denied, the applicant can still be placed in removal proceedings pursuant to the policy of enforcement in effect for the Dept. of Homeland Security.

Although this proposed change is a step in the right direction, there are still risks involved. This proposed change is good for those that have really good possibilities of getting their waiver approved. There are many factors that are considered when granting a waiver. IT IS IMPORTANT THAT YOU SPEAK TO AN ATTORNEY BEFORE DECIDING TO APPLY. Please contact our office for a consultation.
