Congratulations to the DiCello Levitt trial team, led by Partner Corban Rhodes, on a landmark jury victory for the State of New Mexico against Meta.

Working alongside co-counsel Randi McGinn of McGinn Montoya Love Curry & Sievers P.A., our team represented the State at trial and helped secure a verdict finding more than 43 million violations of New Mexico law.

The case centered on Facebook’s representations about user privacy, third-party access to personal data, and its civic integrity practices following the Cambridge Analytica scandal.

This result reflects years of work, meticulous trial preparation, and an extraordinary team effort on behalf of the State of New Mexico and its residents.

Frank E. Tyson died in April 2024 after police officers took him to the ground, handcuffed him, and restrained him as he repeatedly said he could not breathe.

Today, two former Canton police officers were sentenced in connection with his death.

Following the hearing, Partner Bobby DiCello, legal counsel to the Tyson family, issued a statement on behalf of the family:

“Today marks an important point in the criminal proceedings, but it does not end this family’s pursuit of accountability and justice for Frank.”

The Tyson family’s federal civil rights case remains ongoing.

DiCello Levitt is taking on one of the nation’s largest pharmacy benefit managers (PBMs) in a case filed today over allegedly unlawful prescription drug reimbursements.

Together with Arkansas-based Poynter Law Group and Missouri-based Sapp Law, the firm represents a group of independent pharmacies that allege Express Scripts repeatedly reimbursed them below Arkansas’s required National Average Drug Acquisition Cost (NADAC) payment floor across tens of thousands of prescription transactions.

The pharmacies seek compensatory and statutory damages, including hundreds of millions of dollars in statutory damages, as well as court-ordered relief aimed at future compliance.
