In Massachusetts, when family members inherit real estate together and can't agree on what to do with it, any one of them has the legal right to force the issue through something called a partition action.

The court can order the property divided or sold, whether everyone else is ready or not.

Life lately has been a whirlwind, in the best way.

First up, Savannah had the best time in Miami.

Two back-to-back cruises on the Celebrity Beyond took us to the Bahamas and Puerto Rico, and somewhere in between, she also got to check out the Miami Dolphins training camp.

She came home with a signed hat and a signed phone case, feeling like a celebrity herself.

I'll admit it, their kids' experience put our beloved Patriots training camp back home to shame 🏈

Please don't revoke my season tickets for saying that.

On the work side, I got to spend time with two wonderful communities this month.

I gave an estate planning seminar at the Upton Senior Center, followed by another at the Foxborough Community Center, both incredibly well attended.

There's nothing quite like a room full of people showing up because they're ready to protect what matters most.
And finally, I got to do something genuinely close to my heart.

I served as a judge for the Distinguished Young Woman Program of Rhode Island.

That organization does such incredible work building up young women, and I feel so lucky to be even a small part of it. 🙌

Grateful doesn't even begin to cover it.

Every September, you'll see reminders to check your smoke detectors, stock a flashlight, and put together an emergency kit.

All good advice.

But being prepared isn't just about weathering a storm.

It's about making sure your family isn't left scrambling if something happens to you.

I think of an estate plan as part of the same kind of preparation.

A Health Care Proxy so someone can speak for you if you can't.

A Power of Attorney so your bills still get paid.

A will or trust so your family already knows what you wanted, instead of guessing.

An emergency folder so nobody's searching the house for paperwork on the worst day of their life.

National Preparedness Month is usually about batteries and bottled water.

I'd argue the most important thing you can prepare is a plan for the people you love.

If yours isn't in place yet, or it's been a few years since you looked at it, let's use this month as your reminder.

Here's one I see more than people realize 👀

A parent adds one adult child to their checking account "just to help pay bills."

Totally reasonable.

Except in Massachusetts, if that child is added as a joint owner instead of an authorized signer, the account doesn't follow your will when you pass.

It goes straight to whoever's name is on it.

I've watched this quietly undo an entire estate plan.

One sibling ends up with the account balance simply because their name happened to be on it, while the will says everything should be split evenly. Nobody meant for that to happen. It just did.

The fix depends on what you're actually trying to accomplish, help managing bills now, or an inheritance later, because those are two different things with two different setups.

If you've ever added someone to an account "for convenience," it's worth a second look.

I'd rather catch this on a Tuesday afternoon than have your family sort it out during a much harder week.

If I asked you to gather all of your important documents this afternoon...

How long would it take?

Most people immediately think about their Will.

But there are so many other documents families often wish they had during an emergency.

Things like:

Life insurance policies
Healthcare Proxy
Durable Power of Attorney
Property deeds
Military records
Marriage certificate
Social Security information
Vehicle titles
Password manager information
Funeral wishes

When a family is dealing with an unexpected loss or medical emergency, searching through filing cabinets and desk drawers is the last thing anyone wants to do.

One of the greatest gifts you can leave your loved ones isn't just an estate plan.

It's knowing exactly where everything is when they need it most.

One of the challenges with searching estate planning advice online is that not everything you read applies to Massachusetts.

I can't tell you how many times someone has said,

"I read that I could just add a Transfer-on-Death deed to my house."

Here's the thing...

Massachusetts doesn't currently allow Transfer-on-Death deeds for real estate.

That means advice you find online, especially from national articles or social media, may not apply to your situation.

It's one of the reasons I always encourage families to ask questions instead of assuming the internet has the right answer.

Estate planning isn't one-size-fits-all.

And when it comes to protecting your home and your family, local guidance really matters.

Dropped off my college girl last week for her SENIOR year. Not sure how we got here so fast. Emily's happy and thriving and exactly where she needs to be but oh my mama heart.

I always hold it together till I drive away.. something about looking back and watching a woman wave at me, where just five minutes ago a little girl waved at me.. eek. Always so proud of my bug.

The nostalgia hit hard last week.. some days it feels like yesterday I walked these same hills, these hills that shaped so much of who I am today.. to watch it do the same to Emily is an extraordinary privilege and joy. Holy Cross for life.
