Attorney Jay Marsden was thrilled to speak at the beautiful senior living community Laurentide at Mashpee Commons on the Cape this week. He and Care Manager Kelli Fieldhouse of Best of Care had an open discussion on how and when to utilize and elder law attorney and care management services. Having the right providers and planning in place before a healthcare issue or crisis can give families peace of mind and the guidance and support they need.

Your parent passed away. You found the Will. Is that all you need?

Not necessarily.

Being named as executor—or Personal Representative in Massachusetts—doesn't mean you can simply distribute everything immediately. There may be real estate, bank accounts, retirement accounts, insurance policies, debts, taxes, beneficiary designations, and other issues to identify and address.

And sometimes the Will isn't even the document that controls a particular asset.
If you're helping settle a parent's estate, one of the most important first steps is understanding what assets exist, how they're titled, and who is legally entitled to receive them.

Don't make distributions before you understand the entire picture.

What happens if you don't have an estate plan?

A common misconception is that if you don't have a Will, the state gets everything.
That's not generally what happens. But the law—not you—will determine who inherits your assets, and your family may have to navigate a legal process to settle your affairs.

And estate planning isn't just about what happens after you die.

Who will manage your finances if you become incapacitated?

Who will make medical decisions for you?

Who will handle your affairs if you're unable to do so?

A good estate plan answers these questions before there is a crisis.

The goal isn't simply to decide who gets your property. It's to make things easier for the people you love.

When was the last time you reviewed your estate plan?

Your estate plan is more than your Will.
When people think about estate planning, they often think about one document: a Will.
But a comprehensive estate plan may also address:
• Who can manage your finances if you're incapacitated
• Who can make medical decisions for you
• How your home and other assets will be handled
• How assets will pass to your beneficiaries
• Whether a trust makes sense for your circumstances
• What happens if you need long-term care
Your Will is important - but it's only one piece of the bigger picture.
Estate planning is really about making important decisions while you're able to make them.

It was a beautiful day to golf and support the Holliston and Ashland hockey team in their major fundraiser for the season! This co-op team is responsible for raising enough money to support the cost of their practice ice time and essential gear necessary to succeed on and off the ice. Marsden Law was proud to support these hard working young men and wish them the best once they are back in the rink!

Probate Myth:
"Probate is always quick and inexpensive."
Every estate is different, but probate can take months and sometimes longer depending on the circumstances.
Planning ahead can help your family avoid unnecessary delays and administrative burdens.

The cost of long-term care continues to rise, creating financial challenges for many families.

Medicaid planning involves preparing in advance so that individuals can qualify for benefits while preserving as many assets as possible under the law.

The earlier planning begins, the more options may be available.
