𝗡𝗲𝘄 𝗣𝘂𝗯𝗹𝗶𝗰 𝗣𝗿𝗼𝗰𝘂𝗿𝗲𝗺𝗲𝗻𝘁 𝗚𝘂𝗶𝗱𝗮𝗻𝗰𝗲: 𝗔𝗱𝗱𝗿𝗲𝘀𝘀𝗶𝗻𝗴 𝘁𝗵𝗲 𝗜𝗺𝗽𝗮𝗰𝘁 𝗼𝗳 𝘁𝗵𝗲 𝗠𝗶𝗱𝗱𝗹𝗲 𝗘𝗮𝘀𝘁 𝗖𝗼𝗻𝗳𝗹𝗶𝗰𝘁

The ongoing armed conflict in the Middle East has had a significant global economic impact, including on Thailand’s public procurement sector. In response, on 26 March 2026, the Thai Cabinet approved measures proposed by the Ministry of Finance to support parties engaged in public procurement contracts.

Building on this, on 8 April 2026, the Ruling Committee on Public Procurement and Supplies Management issued Letter GorKor (GorWorJor) 0405.2/Wor242 ("𝗚𝘂𝗶𝗱𝗮𝗻𝗰𝗲"), which introduces practical measures to assist government authorities in managing procurement activities affected by the conflict. The Guidance is intended to mitigate the adverse impact on private counterparties contracting with government agencies by allowing a degree of flexibility in the administration of public procurement.

In summary, the Guidance empowers government agencies, as procuring entities, to adopt a range of relief measures across three key stages of public procurement under the Public Procurement and Supplies Management Act B.E. 2560 (2017), namely: (i) contract signing, (ii) contract implementation, and (iii) contract amendment. These include, among others, allowing successful bidders to opt out of contract ex*****on without penalty in certain circumstances, recognising the impact of the conflict as a 𝘧𝘰𝘳𝘤𝘦 𝘮𝘢𝘫𝘦𝘶𝘳𝘦 event (enabling extensions of time and relief from delay penalties), permitting temporary suspension or termination of contracts where performance cannot proceed, and providing flexibility to adjust contract price or scope (particularly for goods and services contracts) to reflect increased costs or changing conditions.

We are delighted to announce the successful conclusion of our 2026 Externship program. Designed as an integral part of the university curriculum, this program offers law students vital hands-on experience within a professional legal environment.

To mark the occasion, our Chairman and Senior Partner, 𝗔𝗷𝗮𝗿𝗻 𝗦𝘂𝗿𝗮𝘀𝗮𝗸 𝗩𝗮𝗷𝗮𝘀𝗶𝘁, shared a heartwarming message, wishing the students success in their future careers and thanking them for their hard work and dedication. The celebration concluded with a farewell luncheon, where everyone enjoyed a variety of delicious local Thai dishes.

It was truly a privilege to host such talented students from 𝗦𝗿𝗶𝗻𝗮𝗸𝗵𝗮𝗿𝗶𝗻𝘄𝗶𝗿𝗼𝘁 𝗨𝗻𝗶𝘃𝗲𝗿𝘀𝗶𝘁𝘆 and 𝗖𝗵𝘂𝗹𝗮𝗹𝗼𝗻𝗴𝗸𝗼𝗿𝗻 𝗨𝗻𝗶𝘃𝗲𝗿𝘀𝗶𝘁𝘆. In celebration of International Day of Happiness 2026, the 𝗥𝗮𝗷𝗮𝗵 & 𝗧𝗮𝗻𝗻 (𝗧𝗵𝗮𝗶𝗹𝗮𝗻𝗱) 𝗟𝗶𝗺𝗶𝘁𝗲𝗱 team recently gathered for a special internal event to spread positivity and appreciation across the office.

To help everyone unwind and recharge, we enjoyed ice cream treats and distributed complimentary orange stress balls—a small gesture to encourage relaxation and ease workplace stress. 🍦🧡

The afternoon featured a fun mini-game with prizes, where colleagues enthusiastically participated, filling the office with laughter and energy. We also introduced a simple yet meaningful question: '𝗪𝗵𝗮𝘁 𝗯𝗿𝗶𝗻𝗴𝘀 𝘆𝗼𝘂 𝗷𝗼𝘆?' Colleagues shared their heartfelt reflections on a dedicated message wall, creating a space filled with positivity.

We were delighted to recently host an aspiring group of law students from the 𝗡𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗨𝗻𝗶𝘃𝗲𝗿𝘀𝗶𝘁𝘆 𝗼𝗳 𝗦𝗶𝗻𝗴𝗮𝗽𝗼𝗿𝗲 (NUS) and 𝗧𝗵𝗮𝗺𝗺𝗮𝘀𝗮𝘁 𝗨𝗻𝗶𝘃𝗲𝗿𝘀𝗶𝘁𝘆 at our Firm!

Key discussion points included trends in merger and acquisition investigations, investigations into unfair market power abuse, cartels to restrict competition, and new challenges arising from the growth of the digital economy and cross-border business operations. The session also facilitated an exchange of views on the differences in legal processes and regulatory practices across the region.

It was a highly productive session that offered a valuable opportunity to harmonise regional perspectives. We would like to thank the TCCT for the insightful discussions. We look forward to more opportunities to collaborate as we navigate the evolving complexities of the regional regulatory environment.

We were honored to participate in a recent public consultation meeting organised by 𝗧𝗥𝗜𝗦 𝗖𝗼𝗿𝗽𝗼𝗿𝗮𝘁𝗶𝗼𝗻 and the 𝗧𝗿𝗮𝗱𝗲 𝗖𝗼𝗺𝗽𝗲𝘁𝗶𝘁𝗶𝗼𝗻 𝗖𝗼𝗺𝗺𝗶𝘀𝘀𝗶𝗼𝗻 𝗼𝗳 𝗧𝗵𝗮𝗶𝗹𝗮𝗻𝗱 (𝗧𝗖𝗖𝗧). The session focused on analysing structural advantages and disadvantages affecting competition within the agricultural industry.

Our Co-Managing Partner, 𝗦𝘂𝗽𝗮𝘄𝗮𝘁 𝗦𝗿𝗶𝗿𝘂𝗻𝗴𝗿𝘂𝗮𝗻𝗴, represented the Firm as a moderator, sharing his views on key legal insights on market competition and the prevention of market harm under Thai trade competition law.

This collaborative session brought together public and private sector stakeholders to share practical perspectives on factors affecting market competition and potential market harm in order to develop policy recommendations for the TCCT. We are proud to contribute to initiatives that promote free, fair competition and prevent monopolistic practices in Thailand.

The Regulation of the Office of the Personal Data Protection Committee on the Examination and Certification of Binding Corporate Rules within the Same Affiliated Business or the Same Group of Undertakings B.E. 2568 (2025) ("𝗡𝗲𝘄 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗶𝗼𝗻"), which was published in the Government Gazette on 17 February 2026, took effect from the date of its publication.

The New Regulation sets out the procedure, criteria, and requirement for submitting an application for the examination and certification of binding corporate rules (BCR) to the Office of the Personal Data Protection Committee in Thailand.
