Rule of Locus Poenitentiae
محمد ندیم نے 2015 میں پنجاب کے ایک سرکاری محکمے میں جونئیر کلرک (BS-7) کیلئے درخواست جمع کروائی۔ محکمہ نے تحریری و زبانی امتحان اور کاغذات کی جانچ پڑتال کے بعد دیگر قانونی لوازمات پورے کرکے اسے کنٹریکٹ پر بھرتی کرلیا۔ ندیم اپنی سرکاری نوکری کے فرائض بہترین انداز میں نبھا رہا تھا، اس کے افسران بھی اس سے خوش تھے۔ ایک سال بعد محکمہ نے ضروری کارروائی کے طور پر ندیم کی اسناد متعلقہ اداروں سے تصدیق بھی کروا لیں۔بعد ازاں حکومت پنجاب نے 2016 میں ایک نوٹیفکیشن کے ذریعے جونئیر کلرک کی پوسٹ کو 11 ویں سکیل میں اپ گریڈ کرتے ہوئے اس پر بھرتی کیلئے تعلیم میٹرک سے بڑھا کر انٹرمیڈیٹ سیکنڈ ڈویژن کردی۔ اسی دوران ندیم نے بھی نوکری کے ساتھ ساتھ تعلیم جاری رکھی اور انٹرمیڈیٹ کا امتحان سیکنڈ ڈویژن میں پاس کر لیا۔ 2018 میں The Punjab Regularization of Service Act 2018‎ نافذ ہو گیا جس کے ذریعے پنجاب کے تمام کنٹریکٹ ملازمین کو ریگولر کرنے کی نوید سنا دی گئی اور مختلف محکموں میں ریگولرائزیشن کا عمل شروع ہو گیا۔ ندیم اپنے محکمہ کے دیگر ملازمین کی طرح شدت سے اپنی نوکری پکی ہونے کا انتظار کر رہا تھا کہ ایک دن اسے اپنے پیروں تلے زمین سرکتی محسوس ہوئی جب محکمہ کی سکروٹنی کمیٹی نے اسے یہ کہہ کر ریگولر کرنے سے انکار کر دیا کہ بھرتی کے وقت جونئیر کلرک کی سیٹ کیلئے مطلوبہ تعلیم میٹرک سیکنڈ ڈویژن جبکہ اس کی تعلیم میٹرک تھرڈ ڈویژن تھی۔ سکروٹنی کمیٹی کی رپورٹ کی روشنی میں محکمہ نے ندیم کو نوکری سے برخاست کردیا۔
سات سال کی سروس کے بعد نہ تو ندیم کے پاس اب کوئی اور آپشن تھی کہ وہ کسی نئی جگہ پر نوکری تلاش کرے اور نہ ہی وہ اپنے قانونی حق سے دستبردار ہونا چاہتا تھا۔ بھرتی کے وقت ندیم نے اپنی اصل اسناد پیش کی تھیں جن کی نہ صرف اس وقت مکمل جانچ پڑتال کی گئی بلکہ مزید ایک سال بعد متعلقہ بورڈ سے تصدیق بھی کروائی گئی۔ مزید یہ کہ جونئیر کلرک کی سیٹ کیلئے مطلوبہ تعلیم بھی انٹرمیڈیٹ سیکنڈ ڈویژن ہے جس پر ندیم پورا اترتا ہے۔
میں نے ندیم کی طرف سے لاہور ہائیکورٹ میں آئینی درخواست (Writ Petition ) دائر کی اور دلائل کے طور پر اعلیٰ عدلیہ کے فیصلہ جات 2009SCMR663, 2006SCMR678, 2011PLC331, 2004SCMR1864, PLD1969SC407 پیش کیے جن کے مطابق بھرتی کے بعد محکمہ کی غلطی کی سزا ملازم کو نہیں دی جاسکتی اور نہ ہی اسے نوکری سے برخاست کیا جا سکتا ہے کیونکہ سروس کے دوران اس کے قانونی حقوق پیدا ہوچکے ہیں (Rule of Locus Poenitentiae) ، بلکہ ان عدالتی نظائر میں وضع کیا گیا ہے کہ مذکورہ ملازم کو نوکری سے نکالنے کی بجائے Appointing Authority کے خلاف کاروائی کرنی چاہیے۔ لاہور ہائیکورٹ نے محکمہ سے جواب طلب کرلیا ہے اور ندیم اب اپنے کیس کی دوبارہ سماعت کا منتظر ہے۔

معاملہ دو وفاقی سرکاری محکموں کے درمیان تھا۔ محکمہ ہائی وے بطور صارف اپنے دفتر کا بجلی کا ماہانہ بل باقاعدگی سے جمع کروا رہا تھا۔ اچانک فیسکو کی طرف سے نوٹس موصول ہوا کہ بل غلطی سے کم بھیجا جا رہا ہے اور پچھلے نامعلوم عرصے سے یہ غلطی مسلسل دوہرائی جارہی ہے لہٰذا موجودہ استعمال شدہ بل کے ساتھ ساتھ گزشتہ ایڈجسٹمنٹ کا مبلغ 33 لاکھ روپیہ بھی جمع کروائیں۔ ہائی وے نے نوٹس اور زائد بل کو سول کورٹ میں دعویٰ استقرار حق کے ذریعے چیلنج کردیا۔ دعویٰ کے ساتھ درخواست حکم امتناعی بھی داخل کی کہ جب تک کیس کا فیصلہ نہیں ہوتا مدعا علیہان (فیسکو) کو صارف کا کنکشن کاٹنے سے منع کیا جائے۔ ٹرائل کورٹ (سول کورٹ) نے درخواست عبوری طور پر منظور کرتے ہوئے ہائی وے کو متنازعہ بل کا 1/3 حصہ ادا کرنے کا حکم دیا اور ادائیگی کی صورت میں فیسکو کو کنکشن منقطع کرنے سے روک دیا۔ ہائی وے کی طرف سے مطلوبہ ادائیگی کے بعد سٹے کو کنفرم کر دیا گیا۔ اب فیسکو نے سول کورٹ کے حکم کے خلاف ڈسٹرکٹ کورٹ میں اپیل دائر کی جسے ایڈیشنل ڈسٹرکٹ جج صاحب نے اس گراؤنڈ پر منظور کرلیا کہ Electricity Act 1910 کی دفعہ 54C کے مطابق سول کورٹ اس وقت تک کنکشن منقطع کرنے سے نہیں روک سکتی جب تک متنازعہ بل ادا نہیں کر دیا جاتا لہٰذا محکمہ ہائی وے 31 اگست سے پہلے مکمل بل جمع کروانے۔
چونکہ عدالت اپیل کے حکم کے خلاف قانونی فورم موجود نہ ہے لہٰذا ہائی وے کی طرف سے میں نے ڈسٹرکٹ جج کے حکم کو آئینی عدالت یعنی لاہور ہائیکورٹ میں چیلنج کیا۔ اپنے موقف کی تائید میں عدالتی نظائر 2017YLR839 اور 2001PLD31 عدالت عالیہ میں پیش کیں جن میں اعلیٰ عدالتوں نے قرار دیا ہے کہ واپڈا نے اگر خود بل کو متنازعہ کیا ہے تو صارف اس متنازعہ بل کو ادا کرنے کا پابند نہیں لہٰذا اس صورت میں دفعہ 54C کا اطلاق بہت محدود ہوگا۔ دلائل سننے کے بعد لاہور ہائیکورٹ نے فیسکو کو ہائی وے کے دفتر کا بجلی کنکشن منقطع کرنے سے روک دیا ہے۔ فیسکو کی طرف سے جواب آنے کے بعد کیس کا حتمی فیصلہ ہوگا۔
